What the inspector wrote

In conjunction with another inspection on 12/09/2025, Licensing Program Analyst (LPA) Deschampe conducted a case management inspection. At 9:03 AM, LPA entered the facility via an unlocked security gate. LPA met with Facility Representative/Assistant Director, Kristine Fernandez and explained the purpose of the visit. Total census was 30 children with 3 staff. A review of the Facility Personnel Report Summary on this date, 12/09/2025 indicates all facility staff and other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. California Code of Regulations (CCR) Section 101238 Buildings and Grounds (g) Disinfectants, cleaning solutions, poisons and other items that could pose a danger if readily available to children shall be stored where inaccessible to children. At 9:12 AM, LPA observed staff bathroom door open (accessible to children), with an air freshener spray on the paper towel dispenser (pictures taken). The FR removed the air freshener immediately and stored it in the office, inaccessible to children. This poses as a potential Health, Safety, or Personal Rights risk to persons in care. CCR 10 1239 Fixtures, Furniture, Equipment and Supplies (a) A comfortable temperature for children shall be maintained at all times. (1) The licensee shall maintain the temperature in rooms that children occupy between a minimum of 68 degrees F (20 degrees C) and a maximum of 85 degrees F (30 degrees C). At 9:55 AM, in the preschool 2 year old room, the temperature gauge displayed 64 degrees (pictures taken). The FR immediately turned on the heater to meet regulation. This poses as a potential Health, Safety, or Personal Rights risk to persons in care. CCR Section 101238 Buildings and Grounds (a) The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. At 9:03 AM, while LPA was walking toward the security gate a parent/authorized representative, carrying 1 infant and walking with another child entered the facility but the security gate did not latch. Approximately 15 seconds later, LPA arrived at the security gate which was not latched/locked/magnetized. LPA entered the facility without entering the security gate code. LPA informed the FR who immediately sent all parents/authorized representatives a text message via ProCare reminding the parents/authorized representatives to ensure the security gate is latched/locked/magnetized. The FR will contact maintenance in order to determine if there is a functional issue with the security gate, as well. This poses as a potential Health, Safety, or Personal Rights risk to persons in care if left unattended. After the inspection, the following deficiencies were observed and are being cited on the attached LIC 809-D and LIC 9102 in accordance with California Code of Regulations (CCR) Title 22 Division 12 Chapter 3: CCR Section 101238(g) Buildings and Grounds (LIC 809-D) CCR Section 101238(a) Buildings and Grounds (LIC 9102) CCR Section 101239(a) Fixtures, Furniture, Equipment and Supplies (LIC 809-D) Exit interview conducted and report was reviewed with the facility representative/assistant director, Kristine Fernandez. Appeal Rights were discussed with facility representative. The facility representative was provided a copy of the appeal rights (LIC 9058 ) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. A notice of site visit was given and must remain posted for 30 consecutive days. The \342\200\234Notice of Site Visit\342\200\235 must be posted on, or immediately adjacent to, the interior side of the main door to the facility. Failure to post will result in Civil Penalties of $100.00. End of report.
