What the inspector wrote

***The purpose of this visit on 12/19/23 is to Amend the original report created on 11/15/23. They take water bottle away and hide it in high place. Staff yell at children when they cry when they miss their moms or when they cry because they are tired. RP stated they had an outbreak of hand foot mouth during the summer, they didn\342\200\231t have coverage for teachers.During investigation, LPA interviewed 4 staff, 3 parents, 3 children and reviewed records. During the initial inspection dated 10/13/23, LPA observed staff speaking to children and engaging in activities with children. At approximately 11:45 am, LPA observed lunch time, and observed children sitting at tables eating lunch together. LPA observed child size table located outside with children's individual water bottles available during outside time. LPA observed water dispensers in each classroom with disposable paper cups which are accessible to children in care. Regarding allegations staff are not ensuring that day care child is fed while in care. Staff are not ensuring that day care child is provided liquids while in care. Staff use inappropriate forms of punishment with day care child while in care: LPA interviewed 4 staff. S1 stated, if the children miss their mommy, staff give them a hug or sit next to them. Staff ask if they want to take a nap if they tell staff they are tired. Staff let children know the time, and they will be picked up soon to go home. S2 stated, facility does not run out of food during mealtimes, but if a child does not want to eat certain food, staff will substitute food item for something they like; for example staff will always have more fruit to give children. Regarding allegation staff yell at day care children while in care. 4 out of 4 staff stated they have never witnessed S4 or any other staff yelling at day care children in care. Regarding allegation facility operating out of ratio. 4 out of 4 staff stated they have not witnessed classrooms being out of ratio. S2 stated, when we need someone for ratio coverage, staff will communicate with director. Staff will switch children in and outside to be sure staff are in ratio, or add another staff member. On July 19, 2023, the facility had a case of hand, foot and mouth. Director Vanessa Duong provided LPA with documentation from the emails sent on July 19, 2023 to all enrolled families to inform them of the hand, foot and mouth case at the facility, and posted notification on front gate.LPA Duron reviewed children\342\200\231s sign in sheets and staff timecards for the summer session starting July 5, 2023 through July 28, 2023, and confirmed the facility was in ratio from July 5, 2023 through July 28, 2023. LPA interviewed 3 children. No disclosure made from the 3 children interviewed. LPA Duron contacted 3 parents. All interviewed parents stated they did not have any concern with facility. Page 2 of 3 Based on the information gathered from LPAs\342\200\231 interviews, observation, and reviewing records, there is insufficient evidence to corroborate the allegations of staff are not ensuring that day care child is fed while in care. Staff are not ensuring that day care child is provided liquids while in care. Staff use inappropriate forms of punishment with day care child while in care. Staff yell at day care children while in care. Facility operated out of ratio. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the allegations did or did not occur in the day care facility, therefore the allegations are UNSUBSTANTIATED. An exit interview was completed. The report was reviewed and discussed. Appeal Rights were provided. The facility representative was provided a copy of their appeal rights and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Licensing office within 15 business days. Any proposed changes to the physical plant, including telephone number, shall be immediately reported to the Department. The facility representative was informed that the \342\200\234Notice of Site Visit\342\200\235 must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00. The \342\200\234Notice of Site Visit\342\200\235 must be posted on or adjacent to the door. Page 3 of 3. End of Report
