101229(a) The licensee shall provide care and supervision... (1) No child(ren) shall be left without the supervision of a teacher at any time... Supervision shall include visual observation.This requirement was not met as evidenced by: Based on interviews, S1 stated they realised C1 was not in the classroom after transitioning the children from the playground into the classroom; and C1's representative stated they found C1 was left alone in the playground, which poses an immediate health, safety, or personal rights risk to persons in care.

101212(d)(1) below, a report shall be made to the Department... within the Department's next working day... in addition, a written report containing the information specified...(d)(2) below shall be submitted to the Department within seven days...This requirement was not met as evidenced by: Based on interview and record review, the facility did not comply with the section cited above. The Director and Acting Director did not report the incident to Department after being informed of the incident which poses a potential health, safety, or personal rights risk to persons in care.

A child who is between 18 months and 36 months of age may participate in the toddler program with written permission from the child's authorized representative. No child in the toddler program shall be placed in the preschool program before the age of 36 months without written permission from the child's authorized representative. This requirement was not met as evidenced by staff interviews, file reviewing, and LPA's observation confirming that C1 from Toddler Option Program have been with preschool children. The licensee failed to abide with this section of Title 22 Regulations. This is a potential risk to the health and safety of children in care.

Child Care Center Directors Qualifications and DutiesIn addition to Section 101215, the following shall apply: All child care centers shall have a director. This requirement was not me as evidenced by a complaint report, staffs' interviews, and LPA's observation. The former director left on 8/16/2024 and our office did not receive any qualifications document regarding any new director. This is a potential risk to the health and safety of children in care

PERSONAL RIGHTS

101223 Personal Rights(a) The licensee shall ensure that each child is accorded the following personal rights:(3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation...This requirement is not met as evidence by: Based on video footage, a child can be seen being patted on their back hard and loud. 4 staff members disclosed witnessing by sight or hearing loud hard back patting on children during nap time. lPA observed S2 patting a child roughly on their back. This action poses an immediate risk to the health and safety to the child in care.

101215.1(d)- Child Care Center Director Qualifications and Duties: The child care center director, or the substitute director as specified in (f) below, shall be on the premises during the hours the center is in operation.This requirement was not met as evidenced by: Through observation and staff interviews it was disclosed that the Director is usually at another campus and only at the facility 1-3 a week.

FIXTURES, FURNITURE, EQUIPMENT AND SUPPLIES

101239(n)- Fixtures, Furniture, Equipment and Supplies: Furniture and equipment shall be maintained in good condition, free of sharp, loose or pointed parts.

Teacher-Child Ratio adult-child ratio Child development programs funded by the California Department of Education and operating under Title 5 of the California Code of Regulations are not required to meet the teacher-child ratios specified in (a) and (b) above. Title 5 staffing ratios shall apply in such centers. (B)Toddlers (18 months to 36 months old) - 1:4; this requirement was not met as evidenced by lpas observation on 102622 ;there were a total of 9 toddlers with 1 staff and 23 preschool aged children with 2 staff at the facility, at total of 33 children with 3 staff(not including 2 staff who were on break)

Personnel RequirementsAll personnel, including the licensee, administrator and volunteers, shall be in good health and shall be physically and mentally capable of performing assigned tasks.Except as specified in (3) below, good physical health shall be verified by a health screening, including a test for tuberculosis performed by or under the supervision of a physician not more than one year prior to or seven days after employment or licensure. This requirement was not met in 2 out of 16 file reviews, S1 did not have health or tb screening done. S2 did not have health screening done. This poses a potential risk to children in care

ARTICLE 2. Administration of Child Day Care Licensing

1596.8662 (b)(1)On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training ...and shall complete renewal...every two years...training.This requirement was not met as evidenced by: Based on records reviewed 2 of 5 staff were missing certificate of completion for mandated reporter training which poses a potential risk to the health and safety of children in care.

101217 Personnel Records(a) The licensee shall ensure that personnel records are maintained on the licensee, administrator and each employee. Each personnel record shall contain the following information: (11)A health screening as specified in Section 101216(g).This requirement was not met as evidenced by: Based on record reviews 3 of 5 staff were missing the health screening report in their files which poses a potential risk to the health and safety of chidren in care.

ARTICLE 1. General Provisions and Definitions

1596.7995 (a) (1) Commencing September 1, 2016, a person shall not be employed or volunteer at a day care center if he or she has not been immunized against influenza, pertussis, and measles. Each employee...influenza vaccination between August 1 and December 1 of each year.THis requirement was not met as evidenced by: Based on records reviewed 1 of 5 staff did not have an immunization card and 2 of 5 staff did not have the flu vaccine or a letter to decline flu vaccine which poses a potential risk to the health and safety of children in care.

TEACHER-CHILD RATIO

101216.3(a) Teacher-Child Ratio: (a)There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance, except as specified in (b) and (c) below. This requirement was not met as evidenced by: Based on interviews conducted with 5 Staff, staff disclosed during interviews of exceeding maximum capacity of 12 to 1, by being out of ratio with 13 children with 1 staff in two preschool classrooms on 12/15/20 and 12/17/20. This poses an immediate safety risk for the children in care.

REPORTING REQUIREMENTS

101212(d)(1)(C) Reporting Req: d)Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) ... In addition, a written report containing the information specified in (d)(2)... (1) Events reported shall include the following: (C)Any unusual incident or child absence that threatens the physical or emotional health or safety of any child.This requirement was not met as evidence by: Based on interviews conducted and records reviewed the child's absence for 10-15 minutes was not reported to parents in a timely manner, nor to Licensing Department as an Unusual Incident Report (LIC 624) This poses a potential immediate threat to the health and safety of children in care.

RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION
