What the inspector wrote

Page 2 During the investigation on 6/5/2023, LPA interviewed seven staff, obtained the facility roster, retrieved Southwest Pest Control invoice and contract, and took pictures and videos of the facility inside and outside. On 6/5/2023 at 11:53 am, staff interviews were being conducted inside the staff lounge. LPA observed a cockroach crawling on the floor near the refrigerator. During staff interviews, staff were asked if they have observed insects inside or outside the facility. Out of six staff interviewed, three staff mentioned they have visually observed cockroaches inside the facility in areas like the kitchen, hallway, classrooms, and janitor closet. Staff witness seeing cockroaches inside the infant classroom by the sink, napkin holder, and refrigerator where food and bottles are stored. Some staff also expressed concerns about the cleanliness inside the classrooms and children’s restrooms. Some staff stated the janitors could do a better job. After staff interviews were conducted, LPA inspected the janitors closet at 12:05 pm with Director present. LPA observed cockroaches on the ground, walls and pipe. LPA entered the infant classroom at 12:07 pm and observed multiple cockroaches behind the refrigerator, cockroaches crawling up the counter and crawling into the base boards on the wall. Cockroaches were also observed inside the kitchen where food is prepped and stored. In reference to the allegation staff do not keep the childcare clean and sanitary. Staff stated when they start their shift, they must sometimes clean the restrooms in the morning and vacuum although a janitorial service cleans in the evening. One staff interviewed stated in the morning the restrooms smell like urine and they have to sanitize and clean. While touring the inside of the facility, LPA observed carpets inside the classrooms with stains and toilet paper on the restroom floors. Parent were interviewed on 6/7/2023 via phone call. Out of nine parents contacted, three were able to be interviewed. Parents interviewed did not divulge any information regarding the allegations. Continue to Page 3 Page 3 Based on LPA observation, interview with staff who mentioned seeing cockroaches in various areas of the facility and inside the infant classroom and expressing concerns about the cleanliness of the facility, the preponderance of evidence standard has been met; therefore, the above allegations are found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division & Chapter 12, is being cited on the attached LIC 9099 D for the deficiency sections 101238 Buildings and Grounds and 101638.1 General Sanitation. Exit interview conducted and report was reviewed with the Assistant Director Sylvia Carrillo . A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Appeal Rights and deficiencies were discussed. Assistant Director Sylvia Carrillo was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days.

This requirement was not met evidence by: Based on observation and interviews with staff members stating they have observed cockroaches in different areas of the childcare center on different dates. This is a potential Health and Safety risk to the children in care.

    101638.1 General Sanitation (e) (e) Washing, cleaning and sanitizing requirements for areas used by staff and children, or for areas that children have access to, shall include: (1) Floors, except those carpeted, shall be vacuumed or swept and mopped with a disinfecting solution at least daily, or more often if necessary. Based on observation and interviews with staff members stating the restrooms and floors are not being cleaned by the janitors, this is a potential Health and Safety risk to the children in care.
