What the inspector wrote

Page 2 of 3 When asked what was wrong, the child responded their “butt”. RP pulled back the child’s diaper and observed pasted feces. RP confronted staff about the soiled diaper and staff responded the children had just returned to the classroom from the playground. RP immediately changed the child’s diaper on the classroom’s changing table. RP noticed pasted on feces and red welts on the child’s buttocks. During initial visit on 11/02/2022, LPA interviewed Assistant Director (AD) and one Staff #1. AD stated all staff are trained on diaper changing during their new hire orientation. AD informed LPA the facility’s communication application also notifies staff when a child’s next diaper change is. AD informed LPA that parents have access to all information entered by staff. AD stated the internet in the facility is unreliable and there have been incidents that the children’s daily activities are not synced properly overnight. AD provided LPA with the daily report for SC which shows a diaper change at 1:38 p.m., after a nap. The next diaper change was at 4:15 p.m., when RP picked up the child, 2 hours and 37 minutes later. AD informed LPA that RP spoke with the facility owner and Director and wanted to recant their complaint to Licensing. During Staff #1 (S1) interview, LPA was informed S1 had not been properly trained on diaper changing procedures from the facility and relied on personal experience. S1 was unaware if the facility’s communication application provided notifications when to change a child or if a diaper changing schedule was needed to be followed regularly. S1 stated diaper changes are generally as needed, in the morning, before, and after naps. S1 stated they were appointed by another staff member to perform most diaper changes. S1 recalls SC waiting to be changed by them, the child was next to be changed. RP arrived at this time, observed SC crying and changed the child themselves on the classroom changing table. Although there is a plan in placed of when to diaper children, the facility failed to meet SC’s needs by not changing his diaper while SC was soiled, causing child a diaper rash. LPA interviewed RP on 11/04/2022. During interview, RP stated staff informed RP the child was next in line to have their diaper changed. RP stated the child suffered four red blisters due to the crusted feces and soaked diaper. RP sent LPA photo of child’s soiled clothing with 10/18/2022 date stamp. RP spoke with facility owner and Director on 11/01/2022. Page 2 of 3 Page 3 of 3 Based on the interviews conducted with Reporting Party, Assistant Director and Staff #1 and record review of facility electronic communication application, the preponderance of evidence standard has been met, therefore the Personal Rights allegation that staff did not ensure child’s diapering needs were met is found to be Substantiated. California Code of Regulations, Title 22, Division 12, 101428(b)(2) are being cited on the attached LIC9099D. LPA Castanon informed Director Nicole Carreon that this report dated 12/13/2022 documents one Type A citation which shall be posted for 30 consecutive days as there are immediate risks to the health, safety, or personal rights of children in care. LPA Castanon also informed the Director to provide a copy of this licensing report dated 12/13/2022 that documents any Type A citations to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Exit interview was conducted with Director Nicole Carreon. Notice of Site Visit was posted during the visit. Director was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Director was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the regional manager to the address listed above. End of Report

This was not met as evidenced by: LPA interviews with Reporting Party, Asst. Director and Staff #1, it was discovered that subject child did not have a diaper check or change for a long period of time. Staff stated the child had just returned from the playground and was about to have their diaper changed when RP picked them up, 2.5 hours after their last diaper change, causing a rash on the child. Children need to be changed as needed. This poses an immediate risk to the personal rights of children in care.
