What the inspector wrote

(Page 1) Licensing Program Analyst (LPA), Giselle Lucero and Licensing Program Manager (LPM) Rina Lopez conducted an onsite inspection for the purpose of an Annual Random. LPA and Director Margarita Calero toured the facility inside and outside. The floor and yard plan (LIC 999) were verified. Upon inspection at 8:25 am one staff was supervising 13 children in classroom # 2. At 8:30 am S#1 arrived to the classroom #2. The regulation requirement is as follows: 101216.3(a) Teacher-Child Ratio There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance. Please refer to LIC 809D for deficiency. Census was taken in each individual classroom. LPA observed a total of 13 preschool age children with 2 staff and 9 toddlers with 2 staff. Facility hours are Monday through Friday, 6:30 AM to 6 PM. During the inspection it was determined the facility is operating within its licensed capacity. A review of the Facility Personnel Report Summary on this date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. During the inspection of the indoor activity space, LPA did not observe any items which could pose a danger to children (poisons, detergents, cleaning compounds, medications or hazardous items). There is pitcher of water available indoors for children in care. Children also bring their water bottles from home. The children's bathrooms are clean and sanitary. Children nap on cots if they choose to sleep, and bedding is stored individually and is taken home weekly to be washed by parents. Food is prepared on site, breakfast, lunch and snacks are provided. Food prep area observed to be clean and sanitary. Food is properly stored. Menus were posted where they could be reviewed by parents. Floors, equipment, and furniture were clean and were observed to be in good repair and free of sharp edges. (continue to page 2) (page 2) The facility has conducted an emergency drill within the past six months, last conducted on 03/10/2023. The facility has a working carbon monoxide detector and fire alarm. Facility met all posting requirement. The California Child Passenger Safety Law was posted by the entrance of the facility. The outdoor activity space was inspected for compliance. The playground was enclosed by a fence at least four feet in height. The surface of the outdoor activity space was well maintained and free of hazards. The turf material commercially produced for the purpose around the climbing equipment, structures, slides and other similar equipment appeared to be enough to absorbs falls. Drinking water in the outdoor activity space is by pitcher that gets refilled in the kitchen. During playground inspection, LPA and LPM observed a plastic playground structure that had a hole on the flooring and a tricycle that had a missing pedal on it. LPA advised Director to remove them from the playground area. No kids were playing outside at the time of observation. There are no bodies of water present at the facility. The facility grounds were safe, sanitary and in good repair. Staff files were reviewed for staff present during the facility inspection this date; 5 staff files were reviewed. Health screening and immunizations as required were reviewed. Beginning September 1, 2016, Health and Safety (H&S) 1597.622 states, a person shall not be employed or volunteer at a childcare center if he or she has not been immunized against influenza, pertussis, and measles. Proof of immunization against pertussis, measles for 5 staff were reviewed and within compliance. Beginning March 31, 2018, H&S Code 1596.8662 requires all directors and employees to complete mandated reporting training, and to renew the training every two years. All 5 Staff had Mandated Reporter Training were completed and none were expired. Teacher present possesses current EMSA approved Pediatric CPR/First Aid certifications, which expires 10/2024. Children's records were reviewed, and there was a separate, complete and current record for each child. A random sample of 5 children's files were reviewed for documentation of the child’s name, address, and telephone number of the child’s authorized representative and of relatives or others that can assume responsibility for the child if the authorized representative cannot be reached when necessary (LIC 700) and a medical assessment. (continue to page 3) (Page 3) In the areas reviewed the children’s files were found to be in full compliance. Sign in/out procedure was reviewed for compliance. The facility currently uses an app called Class Dojo. The person who signs the child in and out uses their full legal signature and records the time of the day. Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Child Care Centers Sections 101173 and 101226. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. The director was informed, and website given, about the California Child Care Disaster Plan has been posted to the UCSF California Childcare Health Program website: cchp.ucsf.edu/content/disaster-preparedness Also provided was information about the E-Learning Modules available at https://ccld.childcarevideos.org . LPA discussed the safe sleep regulations with director and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. (continue to page 4) (page 4) LPA also informed director of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Director was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. In the areas that were evaluated, one Teacher-Child Ratio - Type A: 101216.3(a) deficiency was observed of the California Code of Regulations, Title 22, Division 12 at the time of the visit. Please see LIC 809D. LPA Lucero informed Director Margarita Calero that this report dated 04/21/2023 document(s) one Type A citation(s) which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care. Also, LPA Lucero informed Director Margarita Calero to provide a copy of this licensing report dated 04/21/2023 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
