Inspector’s narrative

What the inspector wrote

On 5/26/2026, Licensing Program Analyst (LPA), Anna Chan, conducted a Case Management visit. LPA met Director Julie Spielman. Overall census observed was 69 children and 10 staff. A review of the Facility Personnel Report Summary shows all facility staff or individuals who require caregiver background checks have received a criminal record clearance and a child abuse index clearance or an exemption clearance. During a subsequent investigation, LPA reviewed Incident and Behavior Reports. Based on record review, Child 2 (C2) has a record of behavior incidents against C2s friends since September 2025. There are incidenta and behaviors reported on September 24, 2025, October 2, 2025 (C2 attempted to harm C1), February 4, 2026, March 18, 2026 and April 2, 2026. The facility confirmed that all those incidents in fact involved C2 being physical to Child 1 (C1). During staff interview, director stated they have a staff, who is Staff 7 (S7), who provide resource to teachers when there are children with behavior challenges. Director stated they pull S7, as their resource teacher to observe, if there is language development or behavior issue there will be a plan in place. LPA interviewed S7, S7 stated they do not have a behavior plan for C2. There are no records of parent meetings for C2s behavior. LPA discovered the facility did not follow its Family Handbook about bullying. Family Handbook page 21 states “A bully is defined as one who hurts (or continually bothers) those who are perceived to be “weaker”. This includes but is not limited to, a single incident or a repetition of physical or verbal confrontations… And immediate disciplinary measures will be taken” Page 1 of 2 LPA interviewed Authorized representative (AP) of C1. AP stated they have requested that C1 be separated to avoid injuries from happening but incident reports keep coming. LPA interviewed C1, C1 stated they do not want to go to school because it is not fun and C2 is always in trouble. In the areas that were evaluated and based on interview and records reviewed, a Type B violation and was cited of the California Code of Regulations Title 22, Division 12 Section 101216 (a) Personnel Requirements. The facility did not follow their Family Handbook in dealing with children who continually hurt or bother other children and did not meet children’s individual needs. Director was reminded that based on Title 22 regulations, a Child care center personnel shall be competent to provide the services necessary to meet the individual needs of children in care and shall at all times be employed in numbers sufficient to meet those needs. Exit interview was conducted with Director Julie Spielman. Report and deficiency was reviewed and discussed. The Notice of Site Visit was posted and must remain posted for 30 consecutive days.
