What the inspector wrote

An unannounced case management report was initiated on today\342\200\231s date by Licensing Program Analyst (LPA) Odom. Upon arrival at around 11:10am LPA met with Staff #1 (S1) who had 15 preschool age children outside the classroom under the patio area, as LPA was taking count of the children, 3 additional children appeared that were inside the classroom utilizing the bathroom without supervision. S1 stated a staff was supervising the children but LPA did not observe any staff inside the classroom. Staff #2 (S2) had 12 preschool age children with them as they were going to grab the food for lunch, then the 3 children that were in the restroom went with S2 making it a total of 15 preschool age children with 1 staff. Both staff were out of ratio. LPA spoke with Director over the phone and director disclosed they were out of town. Director stated there were supposed to be 3 staff in the preschool classroom not sure what happened. At 11:45am Staff #3 took 3 school age children to the preschool classroom to eat lunch with the preschool age children, and at 12:05pm the school age children and preschool age children with getting ready for nap time. At 12:00pm LPA observed an infant teacher came over to assist the preschool age staff. Pictures were taken. At 1:30pm LPA observed S1 had 6 preschool age children and 2 school age children outside playing together. LPA questioned S1 if they were aware that preschool age children and school age children are not supposed to commingle. S1 stated they understand they are not supposed to commingle, due to preschool age children and school age children not wanting to nap S1 had them outside playing together while 2 staff supervised the napping children. A review of adult records indicates that all facility residents, staff, or other individuals who require caregiver background checks have criminal record and child abuse index clearances or exemptions, Based on LPA\342\200\231s observation it was determined that the licensee failed to maintain Teacher \342\200\223 child ratio, supervision and preschool age children commingling with school age children. Continue to page 2 Page 2 Licensee will be cited under the California Code of Regulations, Title 22, Division 12, Chapter 1, Section 101229(a)(1) Responsibility for Providing Care and Supervision, 101216.3(a) Teacher-Child Ratio, 101161(a) Limitations on Capacity. See attached LIC 809D. This report cites Type A violation and shall be provided to parents/guardians of children currently in enrolled and to parents/guardians of children newly enrolled at the facility during the next 12 months. Parents/guardians must sign Form LIC9224 to be kept in each child's file. Exit interview was not conducted with Lead teacher Pushpa Ratnaye, staff did not want to review or sign report. The Notice of Site Visit was posted. Director was informed that the Notice of Site Visit was posted during the visit. Licensee was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Licensee was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the regional manager to the address listed above.

This is an immediate risk to the health and safety of children in care.

This requirement is not met as evidenced by: Based on observation and interviews conducted S1 had 15 preschool age children and S2 had 15 preschool age children upon arriaval.This is an immediate risk to the health and safety of the children in care.
