What the inspector wrote

9099c The following was found; All staff interviewed indicate they do not restrain children or have seen anyone restrain children. LPA attempted to interview 8 children but only 5 were qualified. All children interviewed did not divulge being restrained or seeing anyone being restrained. Interviews with parents did not divulge any information about restraints. Review of training material, no information shows restraints are allowed. Positive discipline is trained. Preponderance of evidence could not be established. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is unsubstantiated . In reference to the allegation that Staff handled child(ren) in a rough manner. Interview with 8 out of 8 staff indicated that they have never observed staff handle children in a rough manner. That they are trained to speak to children. One staff indicated they observed another grab a child by the left arm above the wrist below the elbow and walked him to me, not Montessori teaching but not done roughly." Interview with 5 children did not divulge that staff handle children in rough manner. Interview with 3 out of 5 parents did not divulge information about staff handling a child in a rough manner. Preponderance of evidence could not be established. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is unsubstantiated . In reference to the allegation that Staff spoke inappropriately in the presence of child(ren). incident allegedly involved one staff having an outburst (crying) and speaking rudely to other staff member, in front of children who needed to be consoled, Inside a classroom. Interviews with 8 out of 8 staff indicate that they have not heard staff speak inappropriately in the presence of child(ren) or needing consolation inside a classroom. However, one out of eight staff indicated that staff may have been direct to another staff but not inappropriate. Interviews with 5 children did not divulge that staff spoke inappropriately in their presence. Interviews with 3 out of 5 parents did not divulge information about staff speaking inappropriately in the presence of child(ren). Preponderance of evidence could not be established. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is unsubstantiated . In reference to the allegation that the Facility's outdoor activity space is not free of hazards. Complaint alleges that The wood chips on the playground cause many splinters. Review of records show that the 9099c 2 wood chips used had been tested for; "This test method determines the particle size of the wood fiber type material which provides date indicating sufficient porosity for drainage, yet provide large enough particle size to limit compaction and maintain resiliency, but limit oversize pieces which could lead to injury... Conclusion The above wood fiber meets/exceeds the specification for all particle sizes set forth in section 7 of ASTM F2075. "Test conducted by JetMulch Inc. Interviews with 4 out of 8 staff indicated to either observing or being told about wood chips causing splinters on children's hands. Interview with 1 out of 5 children indicate they had received splinters in their hands. 3 out of 5 parents interviewed did not divulge any issues with playground equipment/mulch. Preponderance of evidence could not be established. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is unsubstantiated . An exit interview was conducted with Ivana Cantuna, Alicia Campus Site Director.. Appeal Rights were explained. The Director was provided a copy of appeal rights (LIC 9058) 01/16) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the Regional Manager to the address listed. The Notice of Site Visit was given and discussed it must be posted as required by H & S Code Sec. 1596.817. Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100.00.
