Inspector’s narrative

What the inspector wrote

On 09/25/24 the Orange County Child Care Office received a complaint alleging (1) Staff yelled at children, and (2) Staff left children unsupervised. Reporting Party (RP) stated the following: on 09/24/24, During outdoor time Staff #8 (S8) was observed screaming at Staff #10 (S10) and Staff #6 (S6) because the children were having conflict and staff did not see it. S8 was also observed yelling at Child #1 (C1). During the investigation, LPA Nunez inspected the facility and interviewed 9 staff members, attempted to interview 6 children but was only was able to interview 4 children due to the qualifications and interviewed 2 parents. LPA also obtain copy of the of the children’s roster and personnel report. Regarding allegation (1) Staff yelled at children: On 10/28/24 and 11/20/24, LPA interviewed 9 staff members. During the staff interviews, 7 out of 9 staff members stated they have not heard a teacher yelled at the children. S2 stated S2 has never seen S8 yell at children. Staff#9(S9) stated there is a poster in each classroom of “Respect the child” that staff members follow. S9 also stated they have monthly meetings and will include training's in children’s behavior an example can include how to positivity reinforce children. On 10/28/24, LPA attempted to interview 6 children but was only able to interview 4 children due to the qualifications. LPA attempted to interview C1 but C1 did not qualified for an interview. 4 out of 4 children stated they have not observed teachers screaming or yelling at the children. Page 2 of 3 Regarding allegation (2) Staff left children unsupervised. On 10/28/24 and 11/20/24, LPA interviewed 9 staff members. During the staff interviews, Staff#1 (S1) stated the following, there was an argument between S8 and S10 due to S10 not being in the correct position where S10 was supposed to be because in the playground staff have assigned positions. S1 stated it did not jeopardize the children’s safety when S10 was not in the correct position. When S10 left the playground there were enough teachers at the playground and were still within ratio. S3 stated the following: S10 walked out of the playground but did not tell anyone and staff had to figure out what had happened. At first, they thought they were out of ratio but when they counted, they were still within ratio. S5 stated a staff member was nearby and went to the playground to supervise the children when S10 left the playground. 4 out of 4 children stated they have not been alone in the playground without a teacher being present. On 11/22/24 and 12/3/2024, LPA called 10 parents and was able to interview 2 parents. The 2 parents did not disclose any concerns. Based on information gather from LPA’s interviews with 9 staff, 4 children and 2 parents, t he preponderance of evidence has not been met. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations (1) Staff yelled at children, and (2) Staff left children unsupervised; therefore, the allegations are UNSUBSTANTIATED. Exit interview conducted and report was reviewed with director Fatima Asghar. Notice of Site Visit was provided to director. The notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. The licensee was provided a copy of their appeal right (LIC 9058 1/16) and their signature on this form acknowledges receipt of these rights. Reporting Party (RP) stated the following: on 09/24/24, During outdoor time Staff #10 (S10) was observed screaming at Staff #8 (S8) and Staff #6 (S6) because the children were having conflict and staff did not see it. During the investigation, LPA Nunez inspected the facility and interviewed 9 staff members, attempted to interview 6 children but was only able to interview 4 children due to the qualifications and interviewed 2 parents. LPA also obtained copy of the of the children’s roster and personnel report. On 10/28/24 and 11/20/24, LPA interviewed 9 staff members. During the staff interviews, 6 out of 9 staff members stated they observed the incident that happened on 9/24/24 between S8 and S10. S10 is no longer employed at the facility. Staff#2 (S2) stated S2 was in the restroom and heard somebody scream, “What happen?!” and it was S8. Staff#4 (S4) stated S4 was in the playground and observed S8 yelled at S10 and the yelling was done in front of the children. S4 asked S8 if S8 can calm down a little. Staff#5 (S5) stated S8 started yelling and it was done in front of the children. On 10/28/24, LPA, attempted to interview 6 children but was only able to interview 4 children due to the qualifications. 4 out of 4 children did not disclose any information pertaining to above allegation. On 11/22/24 and 12/3/2024, LPA called 10 parents and was able to interview 2 parents. The 2 parents did not disclose any concerns. Page 2 of 3 Based on information gather from LPA’s interviews with 9 staff, 4 children and 2 parents, and record reviews, the preponderance of evidence has been met; therefore, the allegation of Staff conduct poses a risk to children in care is UNSUBSTANTIATED. California Code of Regulations, Title 22, Division 12, Chapter 1 Section 101223(a)(1) Personal Rights was being cited on the attached LIC9099D. Please refer to attached 9099D for documentation of deficiencies. Exit interview conducted and report was reviewed with director Fatima Asghar. Notice of Site Visit was provided to director.
