What the inspector wrote

Licensing Program Analyst (LPA) A Bootorabi created a case management report, during a parent interview and cite visit it was discovered that the facility was not operating under the facility schedule. LPA requested copy of the activity schedule for the facility classrooms. It was observed and mentioned by a Parent interviewed (P1) over the phone that the lights in classroom are turned off before the napping period begins. LPA observed children in the footage in their cots prior to 12:30 p.m. It was also mentioned by P1 that their child did not finish their meal in an occasion where lights were turned off early. P1's child interpreted that as nap time and they needed to go to their cot. A consultation was to the director. During today's visit the LPA observed that 4's and 5's classroom lights were off at 12:25 p.m during the end of the tour. The director mentioned that if children are ready for nap time sometime at different times and children can either begin to clean to clean, use the restroom, wash their hands or get a book. The director mentions that if children are not all done with their meal by 12:30 p.m they are given an opportunity to finish their meal and clean up. The census during today's visit was as followed: 5's Room: 7 children & 1 Staff / 4's Room: 17 Children & 2 Staff / 3's Room 17 Children & 1 Staff/ 2's Room 19 Children & 3 Staff / Tots Room 8 Children & 1 Staff The 3's classroom had 17 children with 6 awake on their cots and 1 staff member. The classroom was out of ratio during tour. The facility was not in compliance with the California Code of Regulations, Title 22, Division 12 101173 (d) an d 101216.3(b)(1). The child care center shall operate in accordance with the terms specified in the plan of operation. Exit interview was conducted. Notice of Site Visit was posted during the visit. Licensee, SOLORIO, ALANNAH was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Appeal rights provided and explained. The Licensee was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the regional manager to the address listed above. End of Report

    (2) To be accorded safe, healthful and comfortable accommodations ... to meet his/her needs.Based on LPA’s video observation of children being awake between 12 pm and 3pm on their cots without alternative activities and staff gesturing children to return to their cots after getting up to use the restroom, 5 out of 7 staff (S1,S3,S4,S5,S7)confirming they have children lay or sit on their cots during the nap period, the facility did not comply with the section cited above by means of not having comfortable accommodations to children who are not napping in the center during the facility’s rest period which poses a potential personal rights risk to children in care.

    (d) The child care center shall operate in accordance with the terms specified in the plan of operation. Based on LPA's video observation on 09/07/2023 and Parent Interview it was determined that the facility was not operating in accordance with the terms specified in the plan of operation by means of turning off lights before the scheduled nap time of 12:30 pm this poses a potential health and personal right risk to children in care.

    101216.3(c)(1)(C)Preschool (36 months to enrollment in kindergarten) - 1:8 adult-child ratio.... Based on LPA observation during the facility tour the 3's Classroom had 17 children with one staff; 6 Children were observed to be awake laying on their cots; the ratio was not met by means of not having one fully qualified teacher and one aide for every 18 children in attendance in a preschool program which poses a potential health and safety risk to children in care.
