What the inspector wrote

(Page 2 of Report) During a confidential interview, it was reported that on 10/20/2023, Child #1 (C1) was observed wandering in the classroom during nap time while the teachers were in the classroom and was gone from the classroom's camera for about 10 minutes until C1 was brought back into the cot by the Director. Reporting Party (RP) also stated that Staff #1 (S1) on a separate occasion, made an inappropriate comment about C1 in regarding to C1's behavior in front of C1 and two other children; and on 10/24/2023, S1 was observed not redirecting C1 when C1 was on top of the classroom's table, but another staff redirected C1 to get down from the table. During investigation, LPA reviewed camera footage on 11/02/2023 from 11:30 am-1pm of the classroom, where C1 attended. LPA also interviewed 6 staff members and 4 parents. During record review, LPA could not review footage of classroom on 10/20/2023 and on 10/24/2023 since the facility camera only allows staff to review footage within 48 hours. On 11/03/23, LPA reviewed camera footage of the Twos classroom, between 11:30 am-1pm on 11/02/2023, and observed 5 teachers were supervising 18 children in the Twos classroom. At nap time, LPA observed teachers taking turns to redirect C1 to lay down on the cot. Teachers also were observed to allow space for C1 to calm down as they gave redirection to C1 every 3-5 minutes. C1 were observed walking around in the Twos classroom under direct supervision of the teachers. Due to the angle of the camera, the camera footage did not cover the whole classroom, and did not show the entrance of the classroom; therefore, there were moments, within 2-3 minutes, C1 were not in the video footage. LPA could not determine whether or not C1 walked out of the classroom just from looking at the camera footage. In this reviewed footage, LPA observed C1 attempted to climb on the table and teachers immediately redirect and prevent C1 to climb on the table. During interviews, LPA interviewed 5 staff on 11/03/2023 and 1 staff on 12/11/2023, all interviewed staff denied C1 left the classroom without staff's supervision. Interviewed staff denied making any inappropriate comments about C1 to anyone and in front of any children. Interviewed staff stated C1 climbed on the table at times and staff would redirect C1 and help C1 to get down from the table safely as soon as possible. Interviewed staff denied witnessing any staff allowing any child climbing on top of the table for a period of time without redirection. All interviewed parents shared good feedback about the facility and has no concern related to the allegations. Children interviews were not conducted due to the children were too young to be interviewed. (Continue next page) (Page 3 of Report) Based on the information gathered from LPA interviews conducted with 6 staff and 4 parents, and record review of facility camera footage, there is insufficient evidence to corroborate the allegations that (1) Staff did not prevent child from wandering away from the classroom (2) Staff made inappropriate comments about day care child in children’s presence. (3) Staff did not provide a safe environment for day care children. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove (1) Staff did not prevent child from wandering away from the classroom. (2) Staff made inappropriate comments about day care child in children’s presence. (3) Staff did not provide a safe environment for day care children did or did not occur, therefore the allegations are unsubstantiated. Appeal Rights were explained. The Director was provided a copy of appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the regional manager to the address listed above. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with Director Alannah Solorio. (End of Report)
