What the inspector wrote

During the investigation, LPA inspected the facility, interviewed 13 staff members, 6 children, 3 parents, and obtained a copy of the personnel report, children’s rosters, and the facility's parent handbook. During staff interviews, 13 out of 13 staff members stated that when a child gets injured, they will write a written report and will provide it to the parents. 11 staff members stated if there’s a complaint, they will notify the director. Director stated she will address a concern and try to resolve it. If Director is unable to resolve it, Director will talk to upper management. If they are unhappy with Director, Director will give them the cooperate Corporation number. During the staff interviews, 13 out of 13 staff members also confirmed that there was no electricity at the facility on March 13, 2025. Director stated the following: On 3/13/25 at 6:30am Director came in, and there was no electricity power. Director checked the Edison’s website and saw that there was a power outage. Director stated the power had been out since 5:30am and it would be restored by 3 pm. On 3/21/25,LPA reviewed the facility file and confirmed the Department did not receive any Unusual Incident Report from the facility reporting the “Out of Electricity” incident. Director confirmed that she did not report this unusual incident to Licensing Office as required by Title 22 Reporting Requirements. On 5/14/2025, LPA was able to interview 3 parents, and the 3 parents did not have any concern regarding the allegations. Based on information gathered from LPA’s interviews and record reviews, the preponderance of evidence standard has been met, therefore the allegation is SUBSTANTIATED. California Code of Regulations, Title 22, Division 12 & Chapter 1, Section 101212(d)(1)(C) Reporting Requirements is being cited; see LIC 9099D. Exit interview was conducted, and report was reviewed and discussed with the Director, Elaina Estrada. Notice of Site Visit was posted during the visit. The facility representative was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100 per day. The facility was provided a copy of their appeal rights (LIC 9058 12/15) and their signature on this form acknowledges receipt of these rights. Page 2 of 2

    101161 Limitations on Capacity (a) A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation. This requirement was not met: Based on observation and staff interview, it has been determined that one toddler, 22 months old, was being placed into a preschool room to meet ratios. This poses/posed a potential health, safety or personal rights risk to persons in care.

    (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. a written report containing the information specified in (d)(2) below shall be submitted to the Department within 7 days:Any unusual incident that threatens the physical or emotional health or safety of any child. Based on records review and staff interviews, there was a power outage on 3/13/25 from 5:30 am to about 11:45 am and Director failed to report it to the Department as required. This poses a potential risk to the health, safety, or personal rights of children in care.
