What the inspector wrote

On 5/22/2025, Licensing Program Analyst (LPA) A. Nunez conducted a Case Management – Deficiencies due to deficiencies observed during a visit. LPA informed Assistant Director Daniela Valladolid of the purpose of the Case Management. A review of the Facility Personnel Report Summary shows all facility staff or individuals who require caregiver background checks have received a criminal record clearance and a child abuse index clearance or an exemption clearance. The census at the time were 67 children and 9 staff members. When LPA went to the toddler component classroom to take ratio, Assistant director informed LPA that the 2 staff members that are in the toddler component classroom called out sick today, 5/22/25. Assistant director stated that Child#1 (C1) that is in the toddler component classroom was moved to the 2 year old classroom. C1 is 22 months old. The facility was not in compliance with California Code of Regulations, Title 22, Division 12 & Chapter 1, 101161(a) Limitations on Capacity and is being cited; see LIC 9099D. Appeal Rights were discussed. The facility representative was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. A notice of site visit was provided and must remain posted for 30 days. Exit interview conducted and report was reviewed with the daycare representative. End of Report

    LIMITATIONS ON CAPACITY

    101161 Limitations on Capacity (a) A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation. This requirement was not met: Based on observation and staff interview, it has been determined that one toddler, 22 months old, was being placed into a preschool room to meet ratios. This poses/posed a potential health, safety or personal rights risk to persons in care.

  • REPORTING REQUIREMENTS

    (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. a written report containing the information specified in (d)(2) below shall be submitted to the Department within 7 days:Any unusual incident that threatens the physical or emotional health or safety of any child. Based on records review and staff interviews, there was a power outage on 3/13/25 from 5:30 am to about 11:45 am and Director failed to report it to the Department as required. This poses a potential risk to the health, safety, or personal rights of children in care.
