What the inspector wrote

Licensing Program Analysts (LPA) Aiddee Nunez conducted an unannounced case management visit due to deficiencies observed while reviewing classroom video footage from the infant’s classroom. Upon arrival, LPA met with Director Elaina Estrada. Census was taken and observed a total of 7 infant age children and 4 staff members in the infant room. In the toddler option program there were 7 toddler age children and 2 staff members. A review of the Facility Personnel Report Summary on this date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. During today’s inspection the facility was operating within its licensed capacity and within compliance of staffing ratios. On 1/6/2025, LPA reviewed 37 video footage clips from the infant’s classroom for the months of September 2024 and October 2024. On 9/17/2024 at 11:31am LPA observed Child#1 (C1) on the classroom floor mat with a sleepsuit and Staff#1 (S1) was observed patting on C1’s chest so C1 can fall asleep. C1 falls asleep at 11:34am. C1 was not put in the crib. C1 woke up at 12:15pm and S1 pats on C1 so C1 could falls asleep again. At 12:01pm Staff#2(S2) was observed putting a sleepsuit to Child#2(C2). C2 was on the classroom floor mat and S2 was observed patting on C2 chest so C2 could fall asleep. C2 fell asleep at 12:21pm and was not put in the crib. There were 3 staff members present and 6 infants in the classroom. On 9/19/2024 at 1:00pm Staff#3 (S3) was observed putting a sleepsuit on Child#2 (C2). C2 was on the classroom floor mat and S3 was observed patting on C2 so C2 could fall asleep. C2 fell asleep at 1:15pm on the classroom floor mat with a pacifier that has a stuff animal attached to the pacifier. C2 was on the floor mat asleep with the pacifier that had an attached stuff animal until the video ends at 3:02pm. C2 was not put in the crib. There were 3 staff members present and 7 infants in the classroom. Page 1 of 2 On 9/23/2024 at 11:32am S1 was observed carrying Child#3 (C3) in the arms and placing C3 that is asleep on the butterfly soft playing structure mat and S1 was then observed walking away. C3 was asleep until the video ends at 11:43am and C3 was not put in the crib. There were 3 staff members presents and 5 infants in the classroom. Based on the information gathered from the video footage clips the following deficiencies were cited. The facility was not in compliance of the California Code of Regulations, Title 22, Division 12, Sections 101430(a)(3)(E) Infant Care Activities and 101439.1(a)(1)(A) Infant Care Center Sleeping Equipment. Please refer to 809D for details of deficiency. LPA informed the Director that this report dated 1/13/2025 document a Type A citation, which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care. Also, LPA informed the Director to provide a copy of this licensing report dated 1/13/2025 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Exit interview was conducted with Director, Elaina Estrada. The Notice of Site Visit was posted. Director was informed that the Notice of Site Visit must be posted for 30 consecutive days. The Director was provided with a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the regional manager to the address listed above. Page 2 of 2

    101430 Infant Care Activities (E) If an infant falls asleep before being placed in a crib, staff shall move the infant to a crib as soon as possible.This requirement is not met as evidence by: Based on video footage clips, the infants were observed not being put in the cribs once the infants were asleep. The infants were observed sleeping in the classroom mats. This is an immediate risk to the safety of the children in care.

    101439.1 Infant Care Center Sleeping Equipment (1) Pacifiers shall be allowed in the crib if the following provisions are in place: (A) There shall not be anything attached to the pacifier.This requirement is not met as evidence by: Based on video footage clips, an infant was observed sleeping with a pacifier that had an attached stuff animal on the pacifier. This is a potential risk to the safety of the children in care.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION FOR INFANTS

    Responsibility for Providing Care & Supervision for Infants 101429 (1) Each infant shall be constantly supervised and under direct visual observation and supervision by a staff person at all times. This requirement is not met as evidence by: Based on interviews and video footage reviewed, the staff members were observed to often using their personal cellphone while supervising the infants. This is an immediate risk to the safety of the children in care.

  • 101438.1(b)Type B

    Infant Care General Sanitation 101438.1 (b) Each caregiver shall wash his/her hands with soap and water before each feeding and after each diaper change.This requirement is not met as evidence by: Based on interviews and video footage reviewed, the staff members the staff members do not wash their hands before feeding an infant and after diaper change. This is a potential risk to the safety of the children in care.
