What the inspector wrote

Reporting Party (RP) stated that RP observed Staff #5 (S5) pushed child #1 (C1) back down to sleep when C1 did not want to sleep. The RP also reported that RP observed S5 was frequently yelling at children in care. The RP expressed concern for the children’s safety and well-being. During the investigation, LPA toured the facility, interviewed 5 staff, 5 children, 5 parents, the Reporting Party, and reviewed pertinent documents. Regarding the allegation of “Staff forces children to sleep.” During the staff interview, 5 out of 5 staff denied the allegation of “Staff forces children to sleep.” Staff #1 (S1), staff #2 (S2), staff #3 (S3), staff #4 (S4) stated that they had never seen S5 force C1 to sleep or any children to sleep, and S5 rarely comes to the classrooms during nap time to supervise the children. S5 stated that “S5 never forces C1 to go back to sleep”. All 5 staff stated they only redirect the children to do a different activity whenever the children don’t want to sleep; they never pull, touch, grab or push the children at all. During the physical plant inspection today, 03/16/2026, LPA didn’t observe any staff or S5 forces any children to sleep. Regarding the allegation of “Staff yells at children in care.” During the staff interview, 5 out of 5 staff denied the allegation of “Staff yells at children in care.” Staff #1 (S1), staff #2 (S2), staff #3 (S3), staff #4 (S4) stated that they had never observed S5 yells at children in care. S5 stated that S5 never yells at children in care. All 5 staff stated they never yell at any children in care, and all stated that they talk to the children softly. Plus, they only speak English to the children and never in a different language. During the physical plant inspection today, 03/16/2026, LPA didn’t observe any staff or S5 yells at children in care. During the children interview, all 5 interviewed children did not disclose any information pertaining to the allegations. Page 2 of 3 During the parent interview, all 5 interviewed parents did not divulge any information pertaining to the allegations or express any concerns regarding care of the children. Based on LPA’s observations, and interviews, the preponderance evidence of (1) Staff forces children to sleep and (2) Staff yells at children in care has not been met. Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegations are Unsubstantiated. Exit interview was conducted and report was reviewed with the facility representative Agreda Flor Adriana. Notice of Site Visit was posted during the visit. The facility representative was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Appeal Rights were explained. The facility representative was provided with a copy of the appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the regional manager to the address listed above. End of Report.
