On 4/11/2024, Licensing Program Analysts (LPA) A. Silva conducted a Case Management \342\200\223 Deficiencies due to deficiencies observed during a visit. Upon arrival, the LPAs meet with Ishara Silva. An on-site Facility Personnel Report Summary review indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. Census 42 preschool children the time of visit. The facility was operating within ratios and capacity. On 1/24/24 during staff interviews, Staff 3 (S3) explained that they have held children to prevent them from hurting someone or themselves. S3 said, \342\200\234I was going to mention it that some of the kids get aggressive. There have been times when I held the student. I know I can\342\200\231t hold them forcefully, but it\342\200\231s for the safety of other kids.\342\200\235 S3 added that sometimes children with challenging behavior throw things and holding them is one of the most effective ways of preventing them from hurting other children. S3 added, \342\200\234you came in for a complaint. Maybe I held a student, and someone said you\342\200\231re not supposed to do that\342\200\235. S3 admitted to holding children against their will by the hip but denied it was done forcefully and denied any wrongdoing. Staff stated there was no intent to harm the children but to prevent them from harming others or themselves. Per CCR 101223(a), The licensee shall ensure that each child is provided dignity in his/her personal relationships with staff and other persons. And (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, etc. Based on interviews conducted, the facility is being cited in accordance with the California Code of Regulations, Title 22, Division 12, for the following section: 101223(a) Personal Rights. LPA A. Silva informed licensee Director Ishara Silva that this licensing report dated 4/11/2024 documents one \342\200\234Type A\342\200\235 citation(s). Type A citation(s) must be posted for 30 consecutive days during the hours that children are in care as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. LPA A. Silva further informed Director Silva that a copy of this licensing report must be provided to parents or guardians of all clients currently enrolled by the next business day or by the next day the children are in care, a copy of this report must be provided to the parents or guardians of all newly enrolled clients for 12 months from the date of this report, and signed Acknowledgement of Receipt of Licensing Report (LIC 9224) form, or another written equivalent statement, must be placed in the infant's file for verification of receipt of the report. Appeal Rights were discussed. The facility representative was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. A notice of site visit was provided and must remain posted for 30 days. Exit interview conducted and report was reviewed with director. End.
