What the inspector wrote

An unannounced case management inspection was conducted on this date by Licensing Program Analyst (LPA) Carmen Odom in response to a self reported incident dated 5/11/21. Present during today\342\200\231s inspection was the Director, Vanessa Sener. Census was taken in individual classrooms. The overall census observed was 60 preschool age children and 10 preschool staff members. A review of adult records indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. On 05/11/2021 an Unusual Incident Report was filed with the Department to self-report an incident that occurred on 5/10/2021. Facility administrator called to report 4-5 children were at the entrance door of the classroom without a staff, and 2 children were in the restroom unattended. During rest time (12:00pm to 1:00pm) Staff #2 (S2) stepped into the Bear Classroom to grab an envelope, Staff #1 (S1) was walking 2 children to the restroom in the Bear Classroom, Staff #4 (S4) told S1 only 1 child at a time, S1 escorted Child#1 (C1) to the restroom, S2 told S1 she would watch C1 in the restroom. S1 returned to the breezeway to continue watching the group of children, C1 returned from the restroom, S1 excused Child #2 (C2) to go to the restroom and 2 minutes later excused Child#3 (C3) to go to the restroom, S1 did not escort C2 and C3 to the restroom. S1 stated, I did not see S2 leave the classroom, so I assumed S2 was still in the classroom. At 12:55pm, S1 excused a group of children to begin to pack and put away their mats and rest time bags, from the time of 1:05pm to 1:08pm 5 to 6 children walked in and out into the Bear classroom and put their mats on the rack and bags in their cubbies without a staff in the classroom. During today's inspection LPA interviewed 4 staff members and conducted a physical plant inspection. Based on the information gathered from the interviews conducted, statements from staff and a physical plant inspection. Continue to page 2. Page 2 It was determined there was a lack of supervision on 2 occasions, 2 children were in the restroom for about 2 minutes at a time unsupervised and 5-6 children were inside the classroom putting their mats and bags away in their cubbies without a staff member in the classroom. California Code of Regulations, Title 22, Division 12, Chapter 1, Section 101229(a)(1)- Responsibility for Providing Care and Supervision is being cited on the attached LIC 809D. This report cites Type A violation and shall be provided to parents/guardians of children currently in enrolled and to parents/guardians of children newly enrolled at the facility during the next 12 months. Parents/guardians must sign Form LIC9224 to be kept in each child's file. Exit interview was conducted with Director, Vanessa Sener. Notice of Site Visit was posted during the inspection. Facility representatives was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Facility representatives was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the regional manager to the address listed above.

No child(ren) shall be left without the supervision, including visual observation, of a teacher at any time except as specified in sections 101216.2(e)(1) and 101230(c)(1). This requirement was not met as evidenced by: Based on interviewed and self-reported unusual incident/injury report, 2 children were in the restroom for about 2 minutes at a time unsupervised and 5-6 children were putting their mats and bags away in their cubbies without a staff. This poses and immediate health and safety risk to children in care.
