What the inspector wrote

Page 2 The Department received a complaint on 02/16/24 alleging staff did not prevent Child #1 (C1) from sustaining injuries while in care. Reporting party (RP) disclosed they were concerned the staff are not properly supervising the children in care due to 2 different incidents that occurred on 12/14/23 and 2/14/24. On 12/14/23 RP had to take C1 for medical attention. During the investigation LPA Odom interviewed the 5 staff members, 1 child and 3 parents. On 02/23/24 LPA attempted to interview RP. LPA reviewed the children’s roster, personnel records, ouch reports, unusual incident report, Bright Wheel messages, video recording, picture taken, and 12/19/23 staff meeting agenda. During an interview on 02/23/24, Staff #2 (S2) stated on 02/14/24 C1 was playing outside on the concrete playground with a balloon. C1 ran a couple steps forward and tripped on their own hitting their upper lip on the concrete divider. Staff #1 (S1) was about 5 feet away from C1 supervising the children. C1 walked up to S1 and S1 observed the wound and took C1 to Staff #3 (S3). S3 took the C1 inside to wash the wound and S2 placed an ice pack on C1. S2 stated they immediately attempted to contact RP via phone call and sent a message via Bright Wheel at 8:57am along with a picture of the wound. S2 stated they reviewed the video footage and according to the video footage child tripped and fell on their own, staff were supervising. S2 showed the video footage of the incident to LPA Odom, LPA obtained a copy of the video footage. S2 stated S3 wrote an incident report and report was provided to the family. On 12/14/23 C1 and Child #2 (C2) were playing on the playground slide, when C2 grabbed C1’s arm and pulled it. Staff #6 (S6) was present supervising the children when the incident occurred. S6 placed an ice pack on C1’s left arm, but C1 was not crying or showing signs of injury. S6 notified S2 that C1 was not using their left arm during an activity, in which, S2 called RP at 12:41pm. C1 was picked up at 2:22pm and on 12/15/23 RP notified S2 that C1 received medical attention. S2 stated they sent the unusual incident report to licensing on 12/15/23. S2 stated staff are trained in outdoor supervision, staff will stand on designated areas around the entire playground so there are no blind spots. Continue to page 3 Page 3 LPA Odom interviewed 4 staff members on 02/23/24. S1 stated they were standing a few feet away from C1 when C1 fell. S1 stated they observed blood on C1’s face so they took C1 to S3. S3 took C1 inside to wash off the blood and S1 returned to their designated area of supervision. S3 stated they took C1 inside to wash the wound, and S2 placed an ice pack on C1’s face. S3 stated S2 notified RP immediately after the incident occurred. Staff #4 (S4) stated on 2/14/24 the children were playing with balloons on the playground but S4 did not observe the incident because they were comforting another child that was crying at drop off. Staff #5 (S5) stated on 12/14/24 they observed C2 pulled C1’s arm while they were sliding down the slide. C1 did not cry or show signs of distress, but S5 observed that C1 was not using their left arm while they were inside the classroom. S5 informed S6 who informed S2, S2 immediately informed RP. All the staff disclosed they receive supervision training by the childcare center. On 02/23/24 LPA interviewed 1 child. Child #2 (C2) disclosed C1 fell on the sand and hurt their arm. C2 likes attending the childcare center. LPA attempted to interview 13 parents, however only 3 parents were available for interviews on 03/19/24. Two out of three parents were concerned with the high turnover of staff. Parent #1 (P1) disclosed their playground needs improvement due to uneven pavement. Parent #2 (P2) disclosed their parking lot has potholes and it can be unsafe to walk on. Based on LPA’s facility inspection, observations, interviews conducted with 5 staff, 1 child, 3 parents and records reviewed it was determined there was insufficient evidence that Staff were not supervising C1 when child sustained the injuries. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are Unsubstantiated. Exit interview was conducted with Director Amanda MsGough. Notice of Site Visit was posted during the visit. Director was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the regional manager to the address listed above.
