What the inspector wrote

(page 2) Several parents were interviewed on 12/8/22 via phone call. From their interviews, there was nothing stated to support a preponderance of evidence for this allegation. Based on this gathered information over the course of LPA's investigation the allegation Staff yells at infants in care was not determined to have a preponderance of evidence to support it. In addition to this, LPA was unable to demonstrate that this allegation or that the facility at any point in the past was out of compliance of children's personal rights regulations. LPA was unable to make the determination from the information gathered that this allegation did not ever occur, or that there wasn't a preponderance of evidence to support this allegation, at some point. Due to this reasoning the most factual finding on the allegation, with all available information to LPA during the investigation is unsubstantiated. Based on all this information LPA gathered, the preponderance of evidence standard for this allegation was not met, therefore the allegations is found to be unsubstantiated. From all of the available information obtained by LPA during the course of the investigation, that there is insufficient evidence indicating that Staff yells at infants in care . Based on all of the information LPA gathered, LPA was not able to determine that this allegation was false or untrue. Therefore LPA cannot make the determination that these allegation is unfounded; and the most accurate finding would remain at unsubstantiated. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur; therefore, the allegation is unsubstantiated. Exit interview was conducted, and report was reviewed and discussed. Notice of Site Visit was posted during the visit. The facility representative was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100 per day. The facility was provided a copy of their appeal rights (LIC 9058 12/15) and their signature on this form acknowledges receipt of these rights.

    Infants who are unable to hold a bottle shall be held by a staff person or other adult for bottle feeding. At no time shall a bottle be propped for an infant. An infant shall not be allowed to carry a bottle while ambulatory. A bottle given to an infant able to hold his/her own bottle shall be unbreakable. The above was not met as evidenced by: Based on interviews with staff, it was determined that on occasion staff prop bottles in an infnats mouth when feeding them. This is a potential threat to the children's health and safety.

    INFANT CARE FOOD SERVICE

    Bottles, dishes and containers of food brought by the infant's authorized representative shall be labeled with the infant's name and the current date.This was not met as evidenced by: LPA observed that the facility is not always putting the current date on food items/containers brought from home. Names are indicated but dates are not always indicated. This presents a potential threat to the children's health and safety.

    The airtight container shall prevent the escape of fluids and odors and be portable enough to give to the authorized representative.This was not met as evidenced by: LPA observed that the facility is not always placing soiled diapers/clothing in an airtight container preventing the excape of fluids/odors. This presents a potential threat to the children's health and safety.
