What the inspector wrote

On 4/24/2025 at 9:20am, Licensing Program Analyst (LPA) Sarah Garcia and Licensing Program Manager (LPM) Martha Malane conducted a case management- incident visit in response to a self-reported unusual incident report (LIC 624) received on 03/25/25 regarding allegedly children\342\200\231s personal rights being violated. LPA met with director, Julie Bergman. A walk through of the facility was conducted, and census was taken. Total census was 96 preschool children and 14 staff. A review of staff criminal clearance records on this date 04/24/2025 indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. On 03/25/2025, a self-reported Unusual Incident Report (UIR) was filed with the Licensing Office. The facility reported that on 3/24/24 at approximately 4:50pm, Staff 1 (S1) was hit by a Child 1 (C1) near the left eye. As result, S1 hit C1 on the left shoulder. Per Reporting Party (RP), C1 had no marks or bruises on shoulder. RP reviewed video footage and confirmed the incident occurred and S1 hit C1. S1 terminated on 3/25/25. Parents of C1 notified on 3/25/25 at 1pm. During today's inspection, LPA Garcia interviewed 3 staff and 2 children. LPA obtained LIC 624, incident report, and other relevant documentation. Continued Page 2 Page 2 LPA interviewed 2 children. Child 1 (C1) and Child 2 (C2) were not qualified for an interview. When LPA asked staff about children with challenging behavior, all staff stated they redirect, talk with the child, and allow the child time to collect themselves. Based on interviews and record review, it has been determined that S1 violated the child\342\200\231s personal rights on 3/24/25. LPA Sarah Garcia informed director, Julie Bergman that this report dated 04/24/2025 document(s) (1) Type A citation(s) which shall be posted for 30 consecutive days as there is an immediate risk(s) to the health, safety, and personal rights to the children in care. Also, LPA Garcia informed director, Julie Bergman to provide a copy of this licensing report dated 04/24/2025 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224) or other written statement must be kept in the child's file for verification. An exit interview conducted with Director, Julie Bergman. Notice of Site Visit was provided and must be posted for 30 consecutive days. End of Report
