What the inspector wrote

Page 2: will speak to other child’s authorized representatives regarding the other child’s behavior issues, and staff did not, alleging other child continues “doing stuff” to other children. RP also alleges that C3 was not served breakfast due to being late. RP stated breakfast time at the school is from 8:30 a.m. to 9:00 a.m. and C3 arrives at facility at 10:00 a.m. RP stated facility is not responsible for providing food if C3 is late and will need to bring food from home. RP stated staff will allow C3 to eat if C3 is late. During the course of this investigation, LPA conducted interviews with the Reporting Party (RP), 3 children’s authorized representatives, Director, 3 staff members, and 2 children. LPA obtained the following documentation: Facility Roster, Parent Handbook, Daily schedule, Admission Agreement, C3’s Time Card detail for weeks 2/28/22 to 4/11/22, and a copy of Preschool Menu. Pertaining to the allegations: Staff did not prevent day care child from engaging in inappropriate behaviors and Day care child sustained injuries while in care, during interview conducted with (office staff member), S1, who stated there was one incident involving another child and C3 involving C5 running into C3 with a bike, and stated C5 is aggressive and the staff are working closely with C5 and watching C5 around the children. LPA asked S1 how the staff handle children regarding behavior and S1 stated that the staff “shadow them and watch them more and can intervene before an incident happens.” During interview conducted with the Director (S2), S2 stated there are no children with behavior issues. LPA Gontarek asked the Director what the discipline policy is and S2 stated staff will separate children having conflict, redirect the children, call parents to pick up if necessary, and terminate if behavior persists or worsens. S2 stated would notify parents of an incident via accident or behavior report form, and would give report to the child’s authorized representative at the end of the day. During interview conducted with S5, S5 stated C3 had incidents between children regarding not sharing toys. S5 stated C3 had conflicts/fights with C3’s sibling (C6). During interviews conducted with staff, 3 out of 3 staff stated will separate and redirect children to different activities that are having conflicts as a preventative measure, and did not observe C3 receive injuries. During interviews conducted with 2 children, 2 out of 2 children stated have been hit by another child. 1 out of 2 children interviewed stated did observe C3 get pinched by C1. LPA asked what the teachers do when children hit other children, and 2 out of 2 children stated the teacher will give the child that hit a time out. Pertaining to the allegation: Staff denied day care child food, during interviews conducted with 3 staff, 3 out of 3 staff stated breakfast has always been from 8:30 a.m. to 9:00 a.m. Staff will allow children to eat if children come to school late. Staff informed LPA that if a child is late and does not bring breakfast or lunch, a staff Page 3: member will provide child food. During interviews conducted with staff, S5 stated, “If a parent asks for left over breakfast, I will get the Director to bring breakfast out to the child and have them sit at a table and eat.” S1 stated, “We provide it to them. We never say ‘No.’ We have an open kitchen at all times.” S2 stated, “If they haven't eaten, we'll provide them something. We will request children are dropped off between 8:30 a.m. to 9:00 a.m. If they're hungry, we won't deny them food.” During interviews conducted with 2 children, LPA asked if teachers will let a child that comes late eat, and 2 out of 2 children stated, “Yes.” During interviews conducted with 3 children’s authorized representatives, 3 out 3 made no disclosures regarding the allegations. During record review, LPA reviewed C3’s Time Card detail for weeks 2/28/22 to 4/11/22, and LPA confirmed days and hours for C3, beginning on average at approximately 9:30 a.m. to 10:00 a.m. The times vary from as early as 9:00 a.m. to 12:00 p.m. LPA observed the Daily Schedule, confirming breakfast time from 8:30 a.m. to 9:00 a.m. LPA reviewed the Enrollment Agreement, stating that lunch, morning snacks and afternoon snacks are provided by the school at no extra charge, and food can be brought from home upon request and communication with staff. LPA reviewed Parent Handbook, regarding discipline, and the facility follows the Positive Guidance and Redirecting approach. Under Behavior Management section, it states children displaying inappropriate behaviors will be observed by the director, followed up with a meeting with staff and child’s authorized representative to create a behavior plan, and if behavior does not improve, disenrollment will occur. Based on the information gathered from LPAs' interviews with RP, Director, 2 additional staff, 3 children’s authorized representatives, 2 children, and documentation reviewed, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated. Exit interview conducted with Director, Tina Trenner. A copy of this report and the Appeal Rights (LIC 9058 FAS 01/16) were given and explained. Licensee’s signature on this form acknowledges receipt of these rights. The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site inspection by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.
