What the inspector wrote

On 11/15/24 Licensing Program Analyst (LPA) A. Silva conducted an unannounced Case Management – Deficiencies due to deficiencies observed during a previous visit. Director Silenna Brown assisted the LPA during the visit. Census was 1 child. The facility was operating within its licensed capacity and within compliance of staff-to-child ratios. A Facility Personnel Report Summary review showed that all facility, staff, or other individuals who require background checks have received criminal record and child abuse index clearances or exemptions. CHILDREN RECORDS: Per CCR 101221 Child's Records (a) A separate, complete and current record for each child is maintained in the childcare center. On 11/15/24, LPA observed C1’s file did not have the LIC700. A technical violation was issued. PERSONNEL RECORDS: The LPA reviewed personnel files on 11/14/24. The LPA observed that S2 and S3 did not have proof of required immunizations in file. S3 did not have a TB test in file. On 11/13/24 and 11/14/24, the LPA observed S3 providing care and supervision to children in care. Based on the director’s records and statements, S3 is an aide and began work at the facility on 4/1/24 . During today’s visit S3 was not present at the facility. The director stated that S3 doesn’t work Fridays but will return Monday. Per HSC 1596.7995 Employees or volunteers at day care center; immunization requirements; records; exemptions (a)(1) Commencing September 1, 2016, a person shall not be employed or volunteer at a day care center if he or she has not been immunized against influenza, pertussis, and measles. In addition, per CCC 101217 Personnel Records. (a) The licensee shall ensure that personnel records are maintained on the licensee, administrator, and each employee. During a staff file review, the LPA observed S3, S4, and S5 did not have all the required documentation in file; among the missing documents was a health screening, termination date for S4 and S5, and a tuberculosis test for S3 and S4. A Type B was issued. ROSTER: The LPA observed C1 was not included in the roster. The licensee stated the child was dropped off at school on 11/14/24, which means the child was in attendance in the childcare center before being taken to school. Per HSC 1596.841 Current roster of children provided care in facility required; Each child day care facility shall maintain a current roster of children who are provided care in the facility. This was corrected during the visit. A technical violation was issued. The facility was not in compliance. Violations of the California Code of Regulations, Title 22, Division 6 were observed, discussed, and cited at the time of the visit. The following violations were cited: CCr 1101221 Child's Records(a), 1596.7995(a)(1) Employees or volunteers at day care center; immunization requirements; records; exemptions, 1596.841 Current roster of children provided care in facility required and 101217(a) Personnel Records. The LPA conducted an exit interview and reviewed the report with the licensee. The Notice of Site Visit was posted. The licensee understands that the Notice of Site Visit shall remain posted for 30 days. The Appeal Rights were explained. The licensee received a copy of the Appeal Rights (LIC 9058 01/16), their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First-level appeals should be sent to the Regional Manager at the address listed above.
