What the inspector wrote

Page 2 The Orange County Child Care Office received a complaint 10/19/2023 with three allegations. (1) Staff are operating beyond the terms and conditions of the license, (2) Unqualified staff is providing care and supervision, and (3) Staff did not provide adequate supervision to a day-care child. The reporting Party (RP) mentioned several teachers are being left alone with more children than they should be during nap time when children are not all asleep. Teachers who do not have their units completed have also been left alone with children. RP also mentioned there is not an adequate amount of supervision and a child has been forgotten and left outside by themselves. During the investigation on 10/20/2023, LPA interviewed six staff. All staff interviewed had knowledge of children ratios during classroom activities and nap times. All six staff interviewed stated they have never been out of ratio or witnessed other staff being out of ratio. All six staff were asked if they recalled or witnessed a child being left alone on the play yard. All staff answered “no.” A teacher child ratio of one teacher supervising 24 napping children is permitted provided that the remaining teachers necessary to meet the overall ratio specified in Section 101216.3(a) are immediately available at the center. An aide who is 18 years of age or older, and who meets the requirements of Sections 101216 and 101216.2, may supervise 24 napping children in place of a teacher if the conditions specified in (c) are met. On 10/20/2023 LPA reviewed staff files. It was determined teachers present at the time of the investigation were qualified. On 11/2/2023, LPA conducted parent interviews. LPA contacted 12 parents via phone call. Out of 12 parents, three (3) parents were able to be interviewed. Parents interviewed did not divulge any information regarding the allegations. Continue to Page 3 Page 3 The Orange County Child Care Office has investigated the complaint alleging (1) Staff are operating beyond the terms and conditions of the license, (2) Unqualified staff is providing care and supervision, and (3) Staff did not provide adequate supervision to a day-care child: although the allegations may have happened or are valid, there is not enough preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations is UNSUBSTANTIATED. In the areas that were evaluated, no deficiencies were observed of the California Code of Regulations, Title 22, Division 12 at the time of the visit. Exit interview conducted and report was reviewed with Director Shirley Scholfield. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Appeal Rights discussed. Director was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days.
