What the inspector wrote

Licensing Program Analyst (LPA) Thompson conducted an unannounced Case Management inspection on today's date to review the Confirmation of Removal Letter for Ivana Cantuna. The LPA met with Senior Regional Manager Yuwei He and informed her of the reason for the inspection. The LPA toured the facility inside and outside with Yuwei He . Census was taken and there were 36 preschool age children with 6 preschool age staff members when the LPA began the inspection. A review of the Facility Personnel Report Summary on this date indicates all facility residents, staff, or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. The purpose for this visit is to provide the following letters and to confirm Ivana Cantuna was not present. \302\267 ORDER TO LICENSEE/FACILITY OF IMMEDIATE EXCLUSION FROM FACILITY \302\267 ORDER TO INDIVIDUAL OF IMMEDIATE EXCLUSION FROM ALL FACILITIES: IVANA CANTUNA. LPA Thompson spoke with Yuwei He about the letter issued to 304371592 \342\200\223 Guidepost Montessori at Alicia on December 20, 2023 from Department of Social Services that mentioned Ivana Cantuna may not work or be present in an agency licensed by the Department, unless a criminal record exemption is granted. This Individual must be immediately removed from your agency. An appeal may be submitted within 15 days of the date on the letter. Ivana Cantuna is to remain out of the facility until an appeal is resolved. Yuwei He provided LPA with the Confirmation of Removal (LIC 300A) confirming the removal of Ivana Cantuna was completed on 01/05/2024. Continue to page 2 Page 2 LPA provided Guardian Information and website info: https://www.cdss.ca.gov/inforesources/cdss-programs/community-care-licensing/caregiver-background-check/guardian Yuwei He was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. In the areas that were evaluated, no deficiencies were observed of the California Code of Regulations, Title 22, Division 12 at the time of the visit. Exit interview conducted and report was reviewed with Yuwei He . Notice of site visit was given and must remain posted for 30 days. Failure to comply with the posting requirements shall result in an immediate civil penalty of $100. Appeal Rights were explained. Yuwei He was provided a copy of appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the regional manager to the address listed above.
