What the inspector wrote

Licensing Program Analyst (LPA) Mila Quinto conducted a case management inspection for the purpose of the facility requesting an increase in their capacity from 30 preschool children to 36 preschool children. The facility is currently on a temporary portable childcare located in the parking lot in front of the old childcare facility. Upon arrival,LPA met with the Director, Cherish Guardado and gave LPA a tour of the facility. There were 6 preschool children and 2 staff members, including the Director. The facility has requested to provide care and supervision for 36 preschool children ages 2 to 6 years old, Monday through Friday 7:00 AM to 6.00 PM. A review of the Facility Personnel Report Summary on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. The facility provides morning and afternoon snacks and lunch to children. All areas identified on the Facility Sketch were inspected. The facility has age appropriate furniture and activities including educational, arts & crafts items. Room is well ventilated with proper lighting and shade. There is a working carbon monoxide available in this portable. Parents sign in and out electronically at the entrance of the portable. The indoor measurement of the portable is 1234.10 square feet divided by 35 square feet = 35.26 (35 children) Total of Toilets: 3 X 15= 45 children Sinks: 3 X 15 = 45 children. The bathroom is located inside the portable. There is one sink inside the childcare area. Page 1 of 3 Page 2 of 3 The Outdoor activity space is 3290 square feet divided by 75 = 43.87 (44 children). The playground is located at the old childcare facility. Children will be walked from the portable to and from the playground by staff. The portable is 74 feet away from the playground. A written plan was submitted to Licensing Office on how children are escorted to and from the playground by using a hold a ring walking rope. Outdoor space is completely enclosed. The outdoor activity area is supplied with age and size appropriate equipment with adequate of cushioning materials made of rubber turf under climbing structure and slide. Drinking water is provided by children's own water bottles, and filter water. Fire clearance received from Orange County Fire Authority on 10/25/23 approving the requested capacity of 36 preschool children. However, based on the measurements obtained the facility capacity allows for 35 children. LPA observed the Director's current CPR and 1 st aid, EMSA approved with expiration date of 10/6/2025. The Director was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated. This facility provides Incidental Medical Services \342\200\223 IMS. For IMS information, see PIN 22-02-CCP. A Plan of Operation that includes IMS must be submitted to the Department. Page 3 of 3 Based on measurements obtained both indoors and outdoors, the facility capacity will be reduced to 35. The licensee requested an increase in capacity from 30 to 36 by adding an additional toilet. However, based on the measurements obtained, the facility capacity allows for 35 children. The request for a capacity increase will be submitted for final review. The facility will be notified if any additional information is required. An exit interview was conducted with the director. The Notice of Site Visit was given and discussed it must be posted as required by H & S Code Sec. 1596.817. Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100.00
