What the inspector wrote

Licensing Program Analyst (LPA) Patricia Rivas conducted a case management inspection for the purpose of the facility requesting an increase in their capacity from 35 preschool children to 77 preschool children. The facility is currently on a temporary portable trailer located in the parking lot in front of the original childcare facility. The licensee/applicant designee Mr. Mathiou Zaky is looking to move from the portable unit back to the initially licensed building. Upon arrival, LPA met with the Director, Cherish Guardado who assisted to tour of the portable unit. There were 21 preschool children and 5 staff members, including the Director. Mr. and Mrs. Zaky arrived and provided LPA with tour of the original facility. The facility has requested to provide care and supervision for 77 preschool children ages 2 to 6 years old, Monday through Friday 7:00 AM to 6.00 PM. A review of the Facility Personnel Report Summary on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. The facility provides morning and afternoon snacks and lunch to children. All areas identified on the Facility Sketch were inspected. LPA toured the current portable unit that is licensed for 35 children with a waiver that expires 12/05/24 LPA viewed sufficient furniture equipment and supplies for up to 48 children These supplies will be placed in rooms b & C and some manipulative in room a. LPA toured facility and Room A was staged with furniture equipment and supplies for 24-30children. The total indoor capacity was measured at 2709.36, which is sufficient for the requested capacity. There are 6 toilets and 6 sinks for children's use. There are two adult bathrooms with one sink and toilet in each bathroom. One adult bathroom will be used for children if needed for isolation. page 2 The Outdoor activity space is 3290 square feet divided by 75 = 43.87 (44 children). LPA was advised by licensee that there has been no changes to the outside play area. The outdoor activity area is supplied with age and size appropriate equipment with adequate cushioning materials made of pour and place under climbing structure and slide. The climbing equipment has sticker indicating that tit is for children ages 2 to 5 years old. The playground is completely enclosed with chain link and slat fencing. Drinking water is provided by children's own water bottles, and filter water. A waiver is in place for sharing of playground. Fire clearance received from Orange County Fire Authority on 10/21/24 approving the requested capacity of 77 preschool children with a special condition of;\342\200\235 All conditions of the Temporary Occupancy Certificate shall be met prior to expiration.\342\200\235 LPA was provided documents requested 11/05/24. The Director was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated. Final pictures will be sent to LPA when items are moved. An exit interview was conducted with the director. The Notice of Site Visit was given and discussed it must be posted as required by H & S Code Sec. 1596.817. Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100.00
