What the inspector wrote

Page 2 LPA conducted a visit on 03/29/2024 and 04/10/2024. On 04/10/2024, LPA interviewed two (2) staff members. During the interview with staff, 2 out of 2 staff were able to reiterate infant safe sleep practices. 1 out of 2 stated the older infants who are able to crawl out of a crib sleep in the carpet areas on mats. During visit on 04/10/2024, LPA observed two (2) infants sleeping in the crib area and 6 (six) children sleeping on mats. The mats and cribs being used were observed to be following safe sleep practices. LPA also reviewed safe sleep logs that were fully completed by staff from 04/08/2024-04/12/2024. LPA interviewed three (3) parents. Parents did not make any disclosures regarding the allegations of this complaint. LPA was not able to interview children due to age and language development. Based on LPA\342\200\231s observation, staff interviews and record review, the allegation staff did not follow safe sleep practices may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated. Exit interview was conducted with Office Administrator Binbin \342\200\234Vicky\342\200\235 Zhao. The Notice of Site Visit was posted. Facility representative was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalty of $100. Licensee was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days . End of Report

    101416.5 Staff-Infant Ratio (a) In addition to Sections 101216.3 ... the following shall apply: (b) There shall be a ratio of one teacher for every four infants in attendance. This requirement is not met as evidenced by: Based on LPA's interviews and record review the infant classroom has had many incidents of being out of ratio when all enrolled children attend and ongoing staffing issues. This poses an immediate risk to the health, safety or personal rights to persons in care.

    101416.3 Infant Care Aide Qualifications and Duties ... following shall apply:(b) An infant care aide shall work under the direct supervision of the director, the assistant director or a fully qualified teacher, except as provided for in Section 101416.5(d)(1) This requirement is not met as evidenced by: Based on LPA’s record review and interviews, infant classroom aid was left alone caring for four (4) infants from 4:00pm-5:45pm on 04/05/2024. This poses an immediate health, safety or personal rights risk to persons in care.
