Page 2 During the investigation, LPA toured the facility, reviewed sign-in/out sheets, Daily Schedule, Personal Report, Parent Packet, Job Descriptions, and viewed facility video. LPA also conducted interviews with the reporting party, staff, children, and parents. On 09/16/2024, LPA toured facility with Assistant Director Mariah Pilmer. During inspection LPA toured classrooms, conducted 1 staff (S1) interview, obtained documents, and watched video recording that was dated 9/09/2024 during nap time. At the time of inspection on this date staff were supervising children during rest/nap time. During review of video footage of classroom Room 3 dated 9/09/2024, LPA observed Staff 3 (S3) supporting Child #1 (C1) during nap time. At 1:19PM LPA then saw S3 picked up C1’s cot and moved it next to C2. LPA then noticed at 1:20PM S3 use both their hands to lift up C2 by the armpit area and then laid C2’s body down by force with C2’s feet hitting cot first, then knees, and finally upper body. On 09/19/2024, LPA toured the facility with Assistant Director Mariah Pilmer. During the inspection LPA obtained video footage dated 09/09/2024, toured classrooms, interviewed 5 staff (S2-S5), and 1 qualified child (C3). Teachers were engaged in classroom activities and transitioning children to the playground. On 11/15/2024 LPA received a follow up email from Staff 6 (S6) with information to support the investigation. During staff interviews 5 out of 5 staff stated that personal rights is not forcing a child to do something they do not want to. 4 out of 5 staff stated they have not witnessed another staff member using force on a child during nap time. 5 out of 5 staff stated they will try to support children during nap time if they are struggling with patting backs or rubbing backs. 3 out of 5 staff stated they will provide an alternative like a book for the child to read if a child is not able to nap. 1 qualified child (C3) interviewed, did not divulge any information pertaining to the allegations. Continue to page 3. Page 3. On 11/15/2024, LPA conducted parent interviews. LPA called 8 parents and 3 of the parents called were able to be interviewed. All parents interviewed did not divulge any information pertaining to the allegation or express any concerns regarding care of the children. During todays visit 12/03/2024 LPA reviewed video footage incident with Director Kenya dated 9/09/2024 at 1:20PM and discussed personal rights of children. Based on LPA’s observations, interviews with reporting party, staff, children, and parents, and reviewing video footage, the preponderance of evidence has been met; therefore, the allegation of Staff handled day-care child in a rough manner is Substantiated. California Code of Regulations, Title 22, Division 12, Chapter 1 Section 101223(a)(3), Personal Rights Type A violation is being cited. See LIC9099D for deficiency cited. Exit interview conducted and report was reviewed with Director Kenya Meneses. The director was informed that the “Notice of Site Visit” must be posted on or adjacent to the door for 30 days. Failure to post will result in a Civil Penalty of a $100.00. Appeal Rights and deficiencies were discussed. Director was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. LPA Karen Navar informed Director Kenya Meneses that this report 12/03/2024, documents 1 Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPA informed Director to provide a copy of this licensing report dated 12/03/2024 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. End of Report.
