What the inspector wrote

Page 2 On 03/05/2025, the Orange County Child Care Office received a complaint alleging: 1) Child received unexplained injuries while in care. 2) Staff did not report injury to parent. Reporting Party (RP) stated Child #1 (C1) was picked up from school on 3/03/2025 with a scratch on C1’s bottom and that parent was never informed with what happened. During the investigation, LPA interviewed 6 staff members, no children interview was conducted due to children are being young and non-verbal. LPA also toured the facility on 03/12/2025, staff/child classroom observation, viewed live footage, obtained a copy of Kiddie Academy Personnel Roster, Children’s Roster, Tadpoles Sign in/out Sheets, Accident/Injury Reports dated 3/03/2025, Daily Health Checklist for March 2025, Kiddie Academy Staff Supervision Policy, and Kiddie Academy Tour Kit. Regarding allegation, “Child received unexplained injuries while in care.” During facility visits on 3/12/2025 LPA inspected classrooms, changing table areas, and conducted observations. LPA observed 4 staff (S3-S6) supervising children in care. 3 staff were positioned in separate areas of the classroom participating/engaged with children during activities. 1 staff was checking in children at the door. 6 of 6 staff interviewed stated that Kiddie Academy has a supervision policy for staff and that staff supervision is having a clear line of sight of children and that positioning ourselves apart. 3 staff (S1-S4, S6) interviewed stated that on 3/03/2025 the facility received a call in the afternoon from a Parent 1 (P1) who had stated their child came home with a scratch on their bottom and was wondering what happened. S1 stated they had interviewed 4 staff members. Staff #6 (S6) stated that they did see the scratches, but they were old and scabbed over. S1 also watched video footage from 3/03/2025 of C1 playing on the playground and fell on the bottom and made a general accident/injury report for P1. 3 staff were present on the playground during the incident and child did not show any signs of discomfort. Continue to page 3. Page 3 Regarding allegation “Staff did not report injury to parent.” 6 of 6 staff stated if an injury happens while a child is in care that staff will complete and sign an accident injury report and provide a copy to the parent/guardian to sign and keep. All staff interviewed stated if they did not witness the injury that they will communicate with all staff present and review video footage to try to find out what happened. Administrators stated video footage is limited on how many days it can go back and review; thus, LPA was not able to review the video footage dated 3/3/2025. 6 of 6 staff interviewed stated a general incident report will be given to parents if they are not able to find out what happened. S1 and S2 stated that a report for an accident/ incident regarding C1 had a mark on the bottom was written on 3/03/25 and left for S2 to give to P1 on the morning of 3/04/2025. During LPAs records review of accident injury reports dated 3/03/2025, LPA reviewed a report dated 3/03/2025 and signed by staff/parent with a description revealing C1 had a mark on their bottom. During parent interviews. LPA called 5 parents, and LPA was able to interview 5 parents. The 5 interviewed parents did not divulge any information pertaining to the allegation. Based on LPA observations, interviews, and records review, the preponderance of evidence standard has not been met. Although the allegations may have happened or are valid, there is not enough preponderance of evidence to prove the alleged violations of 1) Child received unexplained injuries while in care and 2) Staff did not report injury to parent did or did not occur; therefore, the allegations are UNSUBSTANTIATED. Exit interview conducted and report was reviewed with Director Kenya, Meneses. The Director was informed that the “Notice of Site Visit” must be posted on or adjacent to the door for 30 days. Failure to post will result in a Civil Penalty of a $100.00. End of Report.
