What the inspector wrote

Page 2. On 03/19/2025, the Orange County Child Care Office received a complaint alleging: 1) Facility staff did not provide adequate supervision resulting in child's injury in care. 2) Facility did not notify child's representative of incident. Reporting Party (RP) stated there have been 2 (two) incidents where child 1 (C1) received injuries in care due to lack of supervision and the parent was not notified of the incidents. RP stated one incident occurred around 2/26/2025 and the other one around 3/18/2025. During the investigation, LPA interviewed 5 (five) staff members (S1-S5), no children interviews were conducted due to children are young and non-verbal. LPA also toured the facility on 03/26/2025, 4/01/2025, and 5/19/2025 and observed staff/child relationships, viewed live footage, obtained a copy of Kiddie Academy Personnel Roster, Children’s Roster, photos, a completed Biting Report dated 2/28/2025 Accident/Injury Report dated 03/18/2025, Tour Kit Welcome Letter, Staff in Service Training Plan, and Kiddie Academy Supervision Policy for staff. Regarding allegation, “Facility staff did not provide adequate supervision resulting in child's injury in care.” During facility visits on 3/26/2025, 4/01/2025, and 5/19/2025 LPA inspected classrooms and observed staff supporting children with different individual needs. LPA conducted 5 (five) staff interviews who stated that supervision is always keeping a watch on children, staff spreading out on the playground to be able to see children on all sides and keeping children safe. 2 (Two) staff recalled a biting incident that took place 2/28/2025 that involved C1. Biting Report stated that during outside time C2 was riding a bike and C1 went to grab C2 off the bike and C1 responded with a bite to C1’s back. Biting Report was written and signed by admin, staff 2 (S2), and P1 dated 2/28/2025. All 5 (five) staff interviewed stated that they knew of an incident that occurred on 3/18/2025 regarding C1 being scratched on the face. S2 stated that C1 was riding on a toy bike/buggy, and the nonverbal child wanted a toy bike/buggy. The nonverbal child grabbed C1 that resulted in C1 being scratch. S2 also stated they witnessed the injury during outside time and offered an ice pack, wrote and signed an incident report on 3/18/2025. S2 left the incident report in the classroom and P1 came and picked it up later that day. 5 (five) staff interviewed stated that when children experience behaviors of concern that staff will stay close by the child so that they can offer support if needed. Staff will communicate with parents and create a behavior report/plan if it becomes a pattern that parents and admin signs. Continue to page 3. Page 3 Administrators stated video footage is limited on how many days it can go back and review; thus, LPA was not able to review the video footage regarding incidents dated 2/28/2025 and 3/18/2025. However, LPA was able to review the live video footage dated 5/19/2025 for 15 minutes. LPA observed teachers were on the playground and were spaced apart while providing care to children. Regarding allegation “Facility did not notify child's representative of incident.” During facility visits on 3/26/2025, 4/01/2025, and 5/19/2025 LPA inspected classrooms and observed staff supporting children with different individual needs. All 5 (five) staff interviewed stated that when children get injured in care that they record the injuries on an Accident/Injury report and that teacher/administration/and parent sign the report. 3 (three) staff interviewed stated that there are behavior reports and biting reports that are completed for children experiencing behaviors of concern. 2 (two) staff recalled an incident that took place 2/28/2025 regarding C1 being bitten. The biting report was written and provided to the parent 2/28/2025. LPA obtained a copy of a Biting Report dated 2/28/2025 that was completed and signed by Reporting Teacher, Family Member, and Supervisor Signature. 3 (three) staff interviewed stated an Accident/Injury report was written for C1 who was scratched on 3/18/2025 and report was provided to the parent. LPA obtained a copy of a completed incident accident/incident report dated 3/18/2025 regarding a scratch with signatures of caregiver, director, and parent. LPA called 5 parents to interview, LPA was not able to reach the parents and left a voicemail for parents to call back. Based on LPA observations, interviews, and records review, the preponderance of evidence standard has not been met. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations of 1) Facility staff did not provide adequate supervision resulting in child's injury in care. 2) Facility did not notify child's representative of incident did or did not occur; therefore, the allegations are UNSUBSTANTIATED. Exit interview conducted and report was reviewed with Assistant Director Mariah, Pilmer. The Assistant Director was informed that the “Notice of Site Visit” must be posted on or adjacent to the door for 30 days. Failure to post will result in a Civil Penalty of a $100.00. End of Report.
