Page 2 On 12/17/2025, the Orange County Child Care Office received a complaint alleging: 1) A staff kissed multiple day care infants near their mouths. 2) Staff failed to report an RSV outbreak in an infant day care room. 3) Facility staff did not give a copy of Type A violation report to parents. Reporting Party (RP) stated they have witnessed staff 4 (S4) kissing infants on their cheeks close to their mouth in Cozy 2 classroom, and that parents were not notified of an outbreak of RSV or a Type A violation. On 12/17/2025 a Co-Complaint was received in the Orange County Regional office stating that staff S4 has been witnessed to have kissed infants in care. During the investigation, LPA inspected the facility unannounced on 01/05/2026 and 01/16/2026, conducted classroom observations in Cozy 2 classroom, obtained/reviewed a copy of The Goddard School Personnel Roster, Child Care Facility Roster, Disciplinary Action-Insubordination and Unprofessional Conduct Report dated 10/15/2025, Formal Staff Complaint Regarding Bullying dated 12/07/2025, Family Handbook Pg.18-19 regarding Health Topics, and reviewed 21 infant records. Conducted 15 (S1-S15) staff interviews, attempted 4 parent interviews, and no interviews with infants due to limited vocabulary. During unannounced facility inspections on 01/05/2026 and 01/16/2026 LPA observed staff caring and supervising infants in care. On 1/16/2026 during LPA\342\200\231s classroom observations of Cozy Cocoon 2 LPA observed 3 (three) staff supporting infants with feeding, sleeping, and supervision needs. During facility observations and facility tour S1 informed LPA that there are cameras at the facility but there are no cameras in the classrooms. Regarding allegation, \342\200\234A staff kissed multiple day care infants near their mouths.\342\200\235 During LPA staff interviews 15 of 15 (S1-S15) staff interviewed stated that an infant/child\342\200\231s personal rights are to treat the child with respect, not to deny them from any of their daily needs, and to give them space. 15 (fifteen) of 15 (fifteen) staff interviewed stated they have not kissed an infant in care. 1 (one) of 15 (fifteen) staff interviewed stated they witnessed a staff kiss an infant in care. During LPA staff interview with S1, S1 stated that they have heard of an incident regarding S4 kissing infants from 2 (two) staff who no longer work at the facility and after internal investigation there was not enough evidence to say that those accusations were in fact true. S1 stated that Cozy Cocoon 2 has experienced some internal personal challenges between staff member relationships that they have been working on. LPA obtained/reviewed documents Disciplinary Action-Insubordination and Unprofessional Conduct Report dated 10/15/2025 and A Formal Staff Complaint Regarding Bullying dated 12/07/2025. Page 3 Regarding allegation \342\200\234Staff failed to report an outbreak in an infant day care room.\342\200\235 During LPA interviews 14 (fourteen) of 15 (fifteen) staff interviewed stated that they had not heard of any communicable illnesses going around the school. 15 (fifteen) of 15 (fifteen) staff interviewed stated that if a child was to get sick at school that they would take their temperature, look for other signs of illness, call the parents, and that the infant/child must be fever free for 24 hrs. before they can return. 3 (three) of 15 (fifteen) staff interviewed stated that they have heard of infants being sick recently. 1 (one) staff interviewed S1 stated that mom (P1) called the school on Monday December 15 th , 2025, stating the infant (C1) was not at school due to being sick with RSV over the weekend and that there were no other cases reported to the school. During records review of The Goddard School Family Handbook Health Topics. LPA reviewed page 19 to state illness reasons you should keep your child home and that parents will be notified if any communicable diseases are reported. S1 stated that a few courtesy phone calls were made to parents in C1\342\200\231s classroom even though the infant was not sick at school. Regarding allegation \342\200\234Facility staff did not give a copy of Type A violation report to parents.\342\200\235 LPA conducted unannounced facility inspections on 01/05/2026 and 01/16/2026 and observed a Type A Report dated 11/20/2025 to be posted adjacent to the entrance door of the facility. During file reviews for 21 infants enrolled, LPA observed LIC9224 Acknowledgement of Receipt of Licensing Reports to be signed, dated and in compliance with Title 22 Regulations. 13 (thirteen) of 15 (fifteen) staff interviewed stated that the parents were notified of the Type A violation and that they were provided with training and solutions regarding Ratio. During parent interviews. LPA called 4 parents and LPA was able to interview 1 parent. The 1 interviewed parent did not divulge any information pertaining to the allegation. Based on LPA observations, interviews, and records review, the preponderance of evidence standard has not been met. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations of 1) A staff kissed multiple day care infants near their mouths. 2) Staff failed to report an RSV outbreak in an infant day care room. 3) Facility staff did not give a copy of Type A violation report to parents; therefore, the allegations are UNSUBSTANTIATED. Exit interview conducted and report was reviewed with Director Chelsea Roe. The Director was informed that the \342\200\234Notice of Site Visit\342\200\235 must be posted on or adjacent to the door for 30 days. Failure to post will result in a Civil Penalty of a $100.00.
