What the inspector wrote

On 10/15/2024, Licensing Program Analyst (LPA), V Trinh conducted an on-site case management inspection in response to an incident that the facility self reported on 10/10/2024. The director, Yareli Juarez, was informed of the visit\342\200\231s purpose and a tour was completed. The census was 58 children, and 11 staff members in the classroom. The facility was operating within teacher child ratios and licensed capacity. An on-site Facility Personnel Report Summary review indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. LPA met with the Center Director, Yareli Juarez. According to the incident report, the facility staff stated while Child 1 (C1) was playing outside on the Climbing Discover Cave structure that (C1) jumped off and landed on their right arm. S1 checked on C1 and reported it to the Director. Staff offered C1 an ice pack and apple juice. The director then checked on C1 and called C1\342\200\231s parent. The C1's parent notified the Director at 4:00 PM on 10/10/2024, that C1 went to CHOC hospital on 10/10/2024, (C1) got broken the back of C1's elbow. C1 returned to school on October 14, 2024. During the course of the investigation, LPA interviewed Center Director Yareli Juarez, and 2 staff members, obtained a copy of the children's roster (LIC 9040), The detail/Age range for age-appropriate toys, and C1\342\200\231s record and incident report. During today's visit, LPA conduct interviews and learned that on October 10, 2024, there were 2 staffs outside on the play yard area with 13 children. C1 was on a 3 ft, and 3 inches climbing and Discovery Cave structure and jumped off and landed on (C1) right elbow as a staff was within 10 steps away from the C1 area. The staff 1 (S1) had just verbally warned the child to be careful and at that moment C1 jumped off from the Cave structure. The staff immediately helped the child up, and checked on C1, who was just 10 steps away. S1 called the Director to notified. Continued page 2 page 2 The director and staffs put ice on the C1 right elbow and contacted the child's mother. Later that day, C1's mother contacted the school to inform that the C1 has broken back of the right side of the elbow. LPA inspected the play yard area to make sure that the facility has enough cushioning material (Synthetic grass, with padding under need) underneath the climbing structures on the playground. The director stated that she will make sure to continue to remind the children to not jump off the toy structures and not to run while they are on the playground. She will also instruct the staff to let the children play in a small section and rotation around of the play yard at a time to be able to keep a closer eye on the children to prevent these type of incidents from happening again in the future. In the areas that were evaluated, no deficiencies were observed of the California Code of Regulations, Title 22, Division 12 at the time of the visit. An exit interview was completed. The report was reviewed and discussed. Appeal Rights were discussed. The Director Yareli Juarez was provided a copy of their appeal rights (LIC 9058 12/15) and their signature on this form receipt of these rights. All appeals must be in writing and received by the office within 15 business days. The facility representative was informed that the 'Notice of Site Visit' must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100.00. The 'Notice of Site Visit' must be posted on or adjacent to the door. Failure to post Type A Reports for 30 days will result in a civil penalty of $100.00. The End of the Report.
