Inspector’s narrative

What the inspector wrote

RP stated, the teacher came into the classroom from the office. RP stated children are commingling in the Land Room with S1; children are also commingling in the evening after 4pm with S2. RP stated the director is never present in the morning during drop off and never seen her there after 4pm. During the course of investigation, LPA toured that facility and reviewed records. LPA conducted interviews with reporting party, 3 staff members, 3 children, 3 parents and reviewed records. LPA attempted to interview Staff #1 (S1). LPA reviewed LIC308 Designation of Facility Responsibility dated 10/15/24. The form designates S1 for facility of Responsibility when Director is not present. Regarding allegation (1) Children were in a classroom unsupervised. LPA interviewed 3 staff members. 3 out of 3 staff members stated they have not witnessed children were in a classroom unsupervised. Staff #4 (S4) stated, No, that has never happened, staff members know they cannot leave the children, there is a rule they cannot even have their phone, they know their priority is supervising the children. Regarding allegation (2) Facility is commingling all age groups during morning and afternoon. LPA interviewed 3 staff members. 3 out of 3 staff members stated that they have not witnessed facility is commingling all age groups during the morning and afternoon. Staff #2 (S2) stated that in the late afternoon the Wind Room and Earth Room are combined for children ages 2 to 5 years. Staff #3 (S3) stated that in the morning both Wind Room and Earth Room meet together in the Earth Room. Staff #4 (S4) stated, staff only combine the preschoolers together in the morning and the afternoon. LPA confirmed from Director, when rooms combine, they are in ratio and do not exceed the approved capacity for the room in which it was licensed for. 3 out 3 interviewed staff stated that facility does not have toddlers enrolled and facility does not combine toddlers with preschoolers. Page 2 of 3 Regarding allegation (3) Director is not present at the facility. LPA interviewed 3 staff members. 3 out of 3 staff members stated they have not witnessed director not present at the facility. Staff #3 (S3) stated, the director is here every day, she comes at different times. Sometimes she is here early and sometimes she stays late, but S1 is in charge when the Director is not here. LPA Duron interviewed 3 children. The 2 qualified children interviewed made no disclosures regarding the above allegations. LPA Duron interviewed 3 parents. All interviewed parents stated they did not have any concern with facility. Based on the information gathered from LPAs\342\200\231 interviews, there are insufficient evidence to corroborate the allegations: (1) Children were in a classroom unsupervised (2) Facility is commingling all age groups in during morning and afternoon (3) Director is not present at the facility. Although the allegations may have happened or are valid, there are not a preponderance of evidence to prove the allegation did or did not occur in the day care facility, therefore the allegations are UNSUBSTANTIATED. An exit interview was completed. The report was reviewed and discussed. Appeal Rights were provided. The facility representative was provided a copy of their appeal rights and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Licensing office within 15 business days. The facility representative was informed that the \342\200\234Notice of Site Visit\342\200\235 must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00.
