Inspector’s narrative

What the inspector wrote

Reporting Party (RP) stated staff did not prevent children from causing harm to other children. LPA interviewed 6 staff, 5 children and 3 parents. Obtained and reviewed Ouch Reports for the children and staff training. During staff interview, Staff 1 (S1) stated they redirect children when they have challenging behavior or when they start to fight against each other and reminds the children to keep their hands to themselves. S1 stated they talk to parents about the children’s behavior but no written behavior plan. S1 is aware of Child 2 (C2) being physical to Child 1 (C1) and they try to separate the children. Staff 2 (S2) stated they redirect children with behavior. S2 stated they are aware of C1 and C2 incidents and try to separate them. Staff 3 (S3) stated they keep an eye on the children and if they have challenging behavior, S3 stated they talk to the children. Staff 4 and Staff 5 are not aware of any incidents with C1 and C2. 3 of 5 staff stated the facility has no behavior plan for C2. Director stated they do not have behavior plans for children with challenging behavior. Director also stated they verbally notify parents about children’s behavior plan and there are no parent meetings recorded for C2 or any children in the facility. Director stated parent meetings are their last resort. LPA interviewed 5 children. C1 stated that C2 knocked them down the bike and hit them. C2 stated they hit their friends when their friends play rough. Child 4 (C4) stated they saw C2 push C1 outside. Child 5 (C5) stated C2 is mean and hit them in the knee. LPA interviewed 3 parents, none of the parents interviewed disclosed information that supports the allegation. LPA reviewed documents; The facility conducted staff training on 12/8/25 regarding Outdoor Safety and Supervision. There are numerous ouch reports for children about negative behavior. LPA reviewed Ouch Reports. Ouch Reports show 2 children have a number of record of behavior incidents against other children. Child 2 record behavior dates (1/28/26, 1/28/26, 2/25/26, 3/2/26, 3/19/26, 3/20/26, 3/31/26.) And Child 4 (C4) record dates (2023, 2024, 2025, 1/14/26, 1/19/26, 1/21/26). The director stated there is no behavior plan for either of the 2 children. Page 2 of 3 Based on interviews and record reviews, the preponderance of evidence standard has been met, therefore the above allegation on Staff did not prevent a daycare child from causing harm to another daycare child is found to be SUBSTANTIATED. See LIC9099D for 1 Type B violation Exit interview was conducted with Director Megan Phan. Report and deficiency were reviewed and discussed. The Notice of Site Visit was posted and must remain posted for 30 consecutive days. Appeal Rights were provided. Page 3 of 3
