Type A. Serious citation. Imminent or substantial risk to children. The regulator requires corrective action immediately and may impose a civil penalty.
Type B. Lower-severity citation. Corrective action required, no imminent risk. The regulator monitors compliance on the next visit.

CRIMINAL RECORD CLEARANCE
Based on record review, the licensee did not comply with the section cited above in staff #1 had a criminal record clearance and was not associated to the facility. The employee has worked at the center since 6/2020 which poses an immediate health, safety or personal rights risk to persons in care. Civil Penalties assessed.

ARTICLE 1. General Provisions and Definitions
Based on record review the licensee did not comply with the section cited above in three out of four employee files reviewed did not contain proof of immunizaiton to MMR and Tdap which posesa potential health, safety or personal rights risk to persons in care.

Reporting Requirements:Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. Any unusual incident or child absence that threatens the physical or emotional health or safety of any child. This requirement was not met as evidenced by: two children engaged in inappropriate touching while under the play structure. Director failed to notify licensing of this occurrence. This is a potential risk to the health and safety of children in care.

RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION
Responsibility for providing care and supervision: The licensee shall provide care and supervision as necessary to meet the children's needs This requirement was not met as evidenced by: there was a lapse in supervision during an art project which resulted in two children engaging in inappropriate touching underneath the play structure. This is an immediate risk to the health and safety of children in care.
