What the inspector wrote

On August 17, 2023 Licensing Program Analyst (LPA) Lea Habtom met with licensee Marlene Banham to open and close a complaint. Upon arrival, LPA observed 1 infant and 7 preschool children being supervised by 2 staff and licensee. All staff present during today’s inspection have fingerprint clearances and associations. Licensee is providing care in garage without authorization During the investigation, LPA Lea Habtom toured the facility, conducted observation, and interviewed those pertinent to the investigation. It was alleged that the licensee is providing care in the garage without authorization. At the time of arrival, LPA Lea Habtom observed 5 children in the garage and also confirmed garage usage for day care children from past inspections. From interviews, LPA Lea Habtom gathered that the garage is not permitted for day care usage. Based on observation and the investigation, LPA Lea Habtom gathered that the licensee is providing care in the garage without authorization to be SUBSTANTIATED: meaning that the allegation is valid because the preponderance of the evidence standard has been met. Title 22 deficiencies were cited on today's inspection on 9099-D. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted with licensee. Appeal rights provided.

This requirement was not met as evidenced by: LPA Lea Habtom observed 5 children in the garage with no proof of the gargage being permitted for day care usage which is an immediate risk to the health & safety of children in care.
