What the inspector wrote

On April 3, 2024, Licensing Program Analyst (LPAs) Lea Habtom and Pa Dao Vang met with owner Paolo Sarmiento to open and close a complaint investigation for the above allegations. Upon arrival, around 12:35 pm, LPAs observed 20 preschool children and 5 school age children being supervised by 2 staff members in one section of the preschool space and 1 staff member in the other section of the preschool space. There were no staff members supervising the 5 school age children at the time of arrival. Paolo stepped out of his office and into the school age area to supervise the school age children. Around 12:45 pm, Paolo was supervising the 5 school age children, an aide supervising 5 awake preschool children and a fully qualified teacher supervising 10 napping children. At 1:00 pm, an aide arrived to supervise the school age children along with Paolo. Staff, reporting party and children interviews also revealed that school age children are left with no supervision. Based on the corroborating information collected and observation, LPAs found the allegation that daycare children are left unattended to be SUBSTANTIATED: meaning that the allegation is valid because the preponderance of the evidence standard has been met. Title 22 Deficiency has been cited on the attached LIC 9099-D . LPA Lea Habtom informed owner Paolo Sarmiento that this report dated April 3, 2024 documents 2 Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPA Lea Habtom informed the designated representative Paolo Sarmiento to provide a copy of this licensing report dated April 3, 2024 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Appeal Rights given.

  • CRIMINAL RECORD CLEARANCE

    101170(e)(1) Criminal Record Clearance: All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility: (1)Obtain a California clearance or a criminal record exemption as required by the Department This requirement was not met as evidenced by a staff, Julia Versace, who is a preschool teacher was providing care with no fingerprint clearance which posses an immediate health and safety risk to the children in care.

  • TEACHER QUALIFICATIONS AND DUTIES

    101216.1(c)(1) Teacher qualifications & Duties: (c)To be a fully qualified teacher, a teacher shall have one of the following:(1) Twelve post-secondary semester or equivalent quarter units in early childhood education or child development completed, with passing grades, at an accredited or approved college or university; and at least six months of work experience in a licensed child care center or comparable group child care program. This requirement was not met as evidenced by LPA observations & interviews that aides are supervising which posses an immediate health & safety risk to the children in care.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    101229(a)(1)Responbility for Providing Care and Supervision: (a)The licensee shall provide care and supervision as necessary to meet the children's needs.(1) No child(ren) shall be left without the supervision of a teacher at any time. This requirement was not met as evidenced by: Interviews conducted and LPAs observation that school age children were left with no staff supervision which posses an immediate health and safety risk to the children in care.
