What the inspector wrote

At 9:05am on 4/25/2025, Licensing Program Analyst (LPA) Matthew Gallo arrived at the facility to continue and deliver findings to open complaint investigations. Upon arrival, LPA was greeted by the office manager, who let LPA into the building and then eventually around to the outdoor play yard, where LPA observed a census of 23 preschool children. At the time of LPA's census of the preschool children in the outdoor play yard, four staff members (S1, S2, S3, and S4) were present providing supervision. Director Paolo Sarmiento was supervising 6 toddlers in the adjacent toddler play yard. Of the staff members supervising the preschool children, S1 and S2 were qualified teachers, while S3 and S4 were aides. However, during LPA's initial time spent in the facility prior to observing the outdoor play yard, LPA observed S2 inside the facility returning from break. Interviews with staff present confirmed that during S2's break, S1, S3, and S4 were providing supervision to the 23 children, with S1 being the only qualified teacher among them. Therefore, the facility did not comply with regulations regarding child-teacher ratio. A Type A Title 22 deficiency is cited on the accompanying LIC809-D Licensee acknowledges, that FOR TYPE A DEFICIENCIES ONLY upon receipt, licensee shall post LIC 809D with Type A deficiencies for 30 days and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. LIC 9224 must be signed by parents/guardians and kept with the children's forms as a receipt whenever any Type A documents are provided by the licensee. LIC 9224 and Appeal Rights were provided. Report continues on 809-C A civil penalty is assessed on the accompanying LIC421FC for the repeat violation of Section 101216.3(b) of Title 22 regulations. A review of facility compliance history shows that a previous deficiency for the same section was cited on 1/21/2025. Due to that date falling within the previous 12 months of today's deficiency, a civil penalty of $250 will be assessed for a repeat violation, accruing $100 per day until the deficiency is corrected. Exit interview conducted and report was reviewed with the facility representative, Paolo Sarmiento. A notice of site visit was given and must be posted for 30 days.
