What the inspector wrote

At 8:55am on 5/9/2025, Licensing Program Analyst (LPA) Matthew Gallo arrived at the facility to conduct a plan of correction visit related to citations issued on 4/25/2025. Upon arrival, LPA observed a census of 25 preschool children supervised by two teachers and an aide. During LPA's visit, the census increased to 30 preschool children. The licensee was previously cited a Type A deficiency on 4/25/2025 for not complying with regulations regarding child-teacher ratio. The plan of correction stated that the licensee will retrain staff about being conscious of ratio numbers prior to taking breaks and that LPA will conduct a return visit to ensure compliance. At 11:20am, LPA observed staff members S1, S2, and S3 on the outdoor playground providing supervision to 30 children. LPA determined that S1 and S2 were teachers, while S3 was an aide without units in early childhood education. Therefore, under Title 22 regulations, these three staff members were qualified to supervise no more than 27 children. Based on the above facts, the plan of correction was not fulfilled. A civil penalty of $1400 is assessed for failure to correct a repeat violation (see 421FC). The civil penalty will accrue $100 a day until the deficiency is corrected. LPA will return to ensure compliance. During the visit, LPA also observed that the notice of site visit documenting LPA's visit on 4/25/2025 and that a Type A citation representing an immediate health, safety, or personal rights violation had been issued was not posted. Regulation requires all notice of site visits to remain posted for 30 days. LPA had posted thee notice on 4/25/2025 prior to leaving the facility. Report continues on 809-C A Type B deficiency is cited on the accompanying 809-D A civil penalty of $100 is assessed on the accompanying LIC421CC due to the facility not complying with the requirement to post notice of site visits for 30 days. Exit interview conducted and report was reviewed with the facility representative, Paolo Sarmiento. A notice of site visit was given and must remain posted for 30 days. LPA provided appeal rights.
