If a teacher wishes to utilize only a portion of that time, they are allowed to do so, or they can adjust their outside time, due to weather. LPA spoke to parents, who explained that although it can be cold in the mornings, their children have never complained, and they do have jackets when they are sent to school. Parents explained that the children are not cold and will run around which keeps them warm. When LPA spoke to the children, they explained that they have jackets, hats, and gloves on, when they go outside. LPA observed many children with these items on, while outside playing. The children explained to LPA that they would also use their pockets if their hands were cold. Based on the information obtained, LPA could not corroborate the allegations. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated. A notice of site visit was provided and will be posted for 30 days.
