Inspector’s narrative

What the inspector wrote

At 9:15am on 8/8/2025, Licensing Program Analyst (LPA) Matthew Gallo met with facility representative Paolo Sarmiento for the purpose of an unannounced annual random inspection. The facility is an infant center with a toddler option, and today's census included 3 infants supervised by 2 staff, and 5 toddlers supervised by 1 staff. Upon arrival, LPA observed all 8 children together in the infant classroom. The gate between classrooms had recently broken, leaving no physical separation between the classes. Facility hours of operation are 6:30am-6:00pm, Monday-Friday, year round. LPA toured the building including all activity and classroom spaces, restrooms, food service and outdoor play areas. All necessary postings were observed. Facility representative stated there were no poisons or firearms on the premises, and LPA did not observe any bodies of water. All toxic and hazardous items were inaccessible to children. Functional carbon monoxide detector was present. Furniture and equipment were in good condition and floors were clean throughout the facility. Playground equipment and surfaces were free of loose or sharp parts, and the areas underneath or around climbing equipment were sufficiently cushioned with wood chips. The food preparation space was free of litter, all food was protected against contamination, and storage containers with solid waste had tight-fitting covers. LPA inspected food stored at the facility and observed containers of two children's food that were not labeled with name or date. Drinking water was readily available to children both indoors and outdoors. Facility uses electronic sign in/out system. No children currently in care take medication. Report continues on 809-C Sufficient napping equipment was available, and LPA reminded Director that napping infants must have 100% visual supervision at all time. LPA discussed the safe sleep regulations with facility representative and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPA also informed facility representative of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. 5 children's records were reviewed and LPA observed that 15 minute checks of napping infants were not being documented. Review of staff records confirmed at least one staff member present today has current Pediatric CPR and First Aid certification, and that all staff currently employed with the facility have valid AB1207 Mandated Reporter Training certificates. Criminal record clearances were also verified, and facility representative was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1- CCP). LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP. Report continues on 809-C Title 22 deficiencies are cited on the following pages of this report. Licensee acknowledges, that FOR TYPE A DEFICIENCIES ONLY upon receipt, licensee shall post LIC 809D with Type A deficiencies for 30 days and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. LIC 9224 must be signed by parents/guardians and kept with the children's forms as a receipt whenever any Type A documents are provided by the licensee. LIC 9224 and Appeal Rights were provided. Exit interview conducted and report was reviewed with the facility representative, Paolo Sarmiento. A notice of site visit was given and must remain posted for 30 days.
