Inspector’s narrative

What the inspector wrote

AD talked to both children and staff about the incident. Staff deny observing C1 color on C2's private parts. C2 stated that C1 did color on their private parts. C1 denied coloring on C2's private part but did acknowledge coloring on C2's bottom and inner thigh. Child #1's childcare services with the facility were terminated on 01/07/2022; therefore, LPA was unable to interview child. Based on interviews conducted and record reviews , the preponderance of evidence standard has been met and the allegation that staff did not prevent day care children from engaging in inappropriate behaviors is found to be SUBSTANTIATED. The facility is being cited in accordance with Title 22 Child Care Center Regulations, Division 12, Chapter 1, Section 101229(a)(1): Responsibility for Providing Care and Supervision. This posed an immediate risk to the health, safety or personal rights risk to the children in care . See LIC9099D for cited deficiency. Exit interview conducted. A copy of this report and appeal rights were d iscussed and provided to the Assistant Director Veronica Tuker on this date. A NOTICE OF SITE VISIT WAS ISSUED AND LPA VERIFIED THAT IT WAS POSTED IN A PROMINENT LOCATION AT THE FACILITY BEFORE LEAVING. THE LICENSEE UNDERSTANDS THAT IT MUST REMAIN POSTED FOR THE NEXT 30 DAYS.

Supervision shall include visual observation.This requirement is not met as evidence by: Based on interviews conducted and record review, staff failed to supervise/observe children in that on 1/04/22, C1 colored on C2's private parts, which posed an immediate health, safety or personal rights risk to children in care.
