    (a) The licensee shall ensure that each child is accorded the following personal rights:(2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. Based on interview and record review, the licensee did not comply with the section cited above as a daycare child ingested chemicals after placing a toy in their mouth which poses a potential health, safety or personal rights risk to persons in care.

    (e) All individuals subject to a criminal record review pursuant...shall prior to working, residing or volunteering in a licensed facility:(2)Request a transfer of a criminal record clearance...This requirement is not met as evidenced by: Based on LPA observation and record review, S1 was working in the preschool classroom without being associated to the facility, which poses an immediate health, safety or personal rights risk to persons in care.

Director and licensee were advised on this specific bin and regulation on the visit conducted on 03/16/23. This waste bin poses a potential health, safety or personal rights risk to persons in care.
