What the inspector wrote

(1) On 07/16/ 2021 at 8:30 am Licensing Program Analyst (LPA) arrived at the facility to conduct an 1 year required annual inspection. LPA was granted entry by Licensee, Maria Perez LPA toured the facility, inside and out, records were reviewed, and the following was observed and/or discussed: Normal days and hours of operation are: Mon-Fri 7:00 am to 5:00 pm OFF-LIMIT AREAS INCLUDE: All upstairs area: 2 nd floor, garage, storage room 1st floor \302\267 The facility is operating within the licensed capacity and appropriate ratios. Yes \302\267 The Licensee is present in the home and has ensured that children in care are supervised. \302\267 When temporarily absent from the home, the Licensee shall arrange for a substitute adult to care for and supervise children \302\267 A working telephone is present. Yes- cell Appropriate fire extinguisher, smoke detector (entry hallway)and carbon monoxide detector (kitchen) is present and were tested by the Licensee during this inspection. Yes \302\267 All hazardous items are inaccessible, this includes detergents, cleaning compounds, medications and other items which could pose a danger to children: Yes locked in laundry room cabinets \302\267 Storage of poisons is inaccessible to children and locked Yes- \302\267 There is a properly barricaded fire place: glass cover and screen \302\267 There are guns or weapons present as stated by the Licensee. Licensee understands all guns, weapons and ammunition must be key locked separately and made inaccessible per Title 22 regulations. Located in : Garage- locked safe, weapon stored separately \302\267 Stairs are barricaded at this time: Yes with gates. \302\267 Home is clean and orderly, with heating and ventilation for safety and comfort \302\267 Safe and appropriate toys and equipment are present for both indoor and outdoor activities. \302\267 Outdoor play areas are fenced, or appropriate supervision is present \302\267 Verification of control of property on file- LPA viewed mortgage statement \302\267 Facility Sketch, Emergency Disaster Plan & Notification of Parent\342\200\231s Rights poster are posted Pediatric CPR and First Aid Card expire on expire 03/2022 Health & Safety Certificate - on file Fire Clearance on file: 05/30/01 There is an in-ground swimming pool enclosed by a five foot mesh and metal gate that opens away from the pool and is self closing/latching. Licensee understands all bodies of water including ponds, above ground pools & spas, in-ground pools & spas, and some fountains must be properly covered or fenced per Title 22 regulations. Clean, safe and age appropriate toys \302\267 Documentation of fire drills on file: Last drill: 06/07/2021 \302\267 Each child\342\200\231s file contains a copy of the emergency information card with required information Criminal record clearances are required prior to all adults living or working in a Family Child Care Home. A civil penalty of $100.00 per day the person has been present, may be assessed. All individuals subject to a criminal record review shall obtain a criminal record clearance or exemption prior to working, residing or volunteering in a licensed home. This was verified on 07/13/2021 The Licensee can submit transfer forms to associate new individuals or to disassociate someone from your facility at: Associations_Disassociations862@dss.ca.gov The Department was granted inspection authority as required by Health and Safety Code The Licensee was informed of their reporting requirements and is provided with the Regional Office\342\200\231s Unusual Incident Reporting email mailbox: UnusualIncidentReportsDO09@dss.ca.gov . Facility is not currently providing IMS at this time. Incidental Medical Services (IMS) policy was discussed. Commonly Asked Questions about Child Care Centers and the ADA, available at: http://www.ada.gov/childqanda.htm For more information on SIDS and Safe Sleep Environments , please visit: California Department of Public Health \342\200\223 California SIDS Program: http://www.cdph.ca.gov/programs/SIDS/pages/default.aspx AAP \342\200\223 Safe Sleep Campaign: http://www.healthychildcare.org/sids/html Safe Sleep Regulations CCR 102425 A-J Licensee was informed of Infant Safe Sleep regulations and provided Departmental PIN: www.cdss.ca.gov/Portals/9/CCLD/PINs/2020/CCP/PIN%2020-24-CCP.pdf The following was reviewed with the licensee(s): - SB 277 \342\200\223 Immunizations, Personal Beliefs Exemption, effective January 1, 2016 - it eliminates the exemption from existing specified immunization requirements based upon personal beliefs, and only allows an exemption from future immunization requirements deemed appropriate by the State Department of Public Health or a medical professional for medical reasons. - AB 290 \342\200\223 Child Nutrition, effective January 1, 2016 - \342\200\223 In accordance with California Health and Safety Code Section 1596.866 - each family day care home licensee who provides care, shall have at least one hour of childhood nutrition training as part of the preventive health practices course. - SB 792 \342\200\223 Immunization requirements for staff, volunteers, effective September 1, 2016 \342\200\223 (a) (1) Commencing September 1, 2016, a person shall not be employed or volunteer at a family day care home if he or she has not been immunized against influenza, pertussis, and measles.. - AB 2231 (2016) \342\200\223 Increased Civil Penalties, effective July 1, 2017 \342\200\223 For failing to correct a violation the civil penalty is increased to $100 per day for EACH violation until corrected; Failing to correct a repeated violation- civil penalty is increased to $250 immediately assessed, and $100 per day afterwards for EACH repeated violation until corrected; For an Immediate Risk violation the civil penalty is increased to $500 immediately assess, and $100 per day for EACH violation after that until corrected; For any repeated Immediate Risk violations the civil penalty is increased to $1,000 immediately assess, and $100 per day afterwards for EACH repeated violation until corrected. NOTE: Repeat violations are defined as a violation of a previously cited statutory or regulatory Section and/or subsection within 12 months prior. - AB 1207 \342\200\223 Mandated Child Abuse Reporting: Child Day Care Personnel Training, beginning January 1, 2018 \342\200\223 Requires all licensed providers to complete training as specified on their mandated reporter duties and to renew their training every two years. - AB2370 \342\200\223 Effective January 1, 2019 \342\200\223 Lead Poisoning \342\200\223 providers are required to provide a lead toxicity prevention handout to parents/guardians of newly enrolled children with information on risks and effects of lead poisoning; blood lead testing recommendations and requirements. - Effective January 1, 2017 \342\200\223 Children under 2 years of age shall ride in a rear-facing car seat unless the child weighs 40 or more pounds OR is 40 or more inches tall. For additional information regarding car seat laws see www.chp.ca.gov Effective September 15. 2020, Safe Sleep Regulations CCR 102425 A-J Additionally the following was discussed: - Access to forms & Regulations for Family Child Care online at www.ccld.ca.gov - Responsibility to know the regulations for anyone providing care - Inaccessibility of hazards must be constantly reassessed depending on the children in care - Current facility\342\200\231s phone numbers must be on file at all times. - Failure to meet the posting requirements shall result in an immediate $100 civil penalty. - Documentation of fire & earthquake drills are to be conducted every six months - Responsibilities of being a mandated reporter: Childcare expires: 07/2023 General- pending - Baby walkers, bouncy seats, exersaucers and other similar items are prohibited - The licensee is urged to visit the U.S. Consumer Product Safety Commission webpage at www.cpsc.gov to ensure that equipment purchased for the day care has not been recalled. - Once licensed, The Notice of Site Visit must be posted at the entrance of the facility for a period of 30 days. If a serious violation is cited, a copy of the licensing report (LIC809/LIC9099) must also be posted for 30 days. A civil penalty of $100 per violation will be assessed for noncompliance. - Please subscribe at www. childcareadvocatesprogram to receive Department updates. This website can also be accessed through www.ccld.ca.gov -Duty Officer is available to answer questions Mon. -Fri. at 1-844-LET-US-NO (1-844-538-8766). No cited deficiencies this visit. During the exit interview, the LICENSEE, Cassandra Stevens confirmed that there are no Registered Sex Offenders living in the facility and/or using the facility address for their mailing address. As a REMINDER: when your child(ren) turn 18 years of age, you MUST SUBMIT an updated LIC279, LIC508 and TB Screen and have your child submit for LIVESCAN background clearance. This also applies to any adult PRIOR to them moving into the home or who currently lives in the home. Also, PRIOR to employment of any adult, you must submit the LIC508, TB screening and obtain a background clearance through LIVESCAN. A NOTICE OF SITE VISIT WAS ISSUED AND LPA VERIFIED THAT IT WAS POSTED IN A PROMINENT LOCATION AT THE FACILITY BEFORE LEAVING. THE LICENSEE UNDERSTANDS THAT IT MUST REMAIN POSTED FOR THE NEXT 30 DAYS ALONG WITH A COPY OF ALL TYPE A DEFICIENCIES (LIC9099D) CITED DURING THIS INSPECTION. A copy of this report was provided to the licensee on this date and must be made available to the public upon request for the next 3 years.
