separate occasions, took a census, and observed that the center was in compliance with ratio and capacity requirements. All interviews indicated that when classrooms approach ratio limits, especially during transitions, additional staff are brought in to maintain compliance. Concerning the allegation that staff do not provide adequate supervision, specifically that staff use personal cell phones in the classroom, three out of five staff confirmed that phone use during work hours had been an issue. As a result, the facility held a meeting on May 29, 2025, to address classroom expectations and the prohibition of personal cell phone use while supervising children. In response to the allegation that a child was left in a soiled diaper for an extended period, it was noted that the majority of children in the three-year-old classroom are potty trained, and this classroom does not contain a changing table. When necessary, children who are not fully potty trained are taken to a nearby classroom equipped with a changing table. Of the six staff interviewed, two reported having conversations with administration about concerns related to a child being left in a soiled pull-up upon leaving the facility. With regard to restroom cleanliness, LPA reviewed the daily cleaning log, which is signed by closing staff each day. While two out of six staff stated that the restrooms could be cleaner and at times observed them in disarray, all interviewed parents reported that they had never witnessed the restrooms to be unclean or unsanitized. For the allegation that staff yell at children, two out of six staff confirmed witnessing staff raise their voices. One staff member described an incident in which S3 yelled at a child who attempted to hit another child with a toy; this occurred in the presence of a parent. However, none of the interviewed parents reported witnessing or being informed of staff yelling at children. Lastly, regarding the allegation that staff handle children in a rough manner, specifically, that staff grab children by the arm to get them to sit during lunch, confidential interviews revealed that while staff had occasionally seen others guide children by the arm, it was never done in a rough or malicious manner. Parents also denied ever witnessing or hearing about staff handling children roughly. Based on the information obtained, it has been determined that although the allegations may have occurred or are credible, there is not a preponderance of evidence to prove that the violations did or did not take place. Therefore, the allegations that the facility is operating out of ratio, staff are not providing adequate supervision, a child was left in a soiled diaper for extended periods, restrooms are not adequately cleaned and sanitized, staff yell at children, and staff handle children roughly, are all UNSUBSTANTIATED. An exit interview was conducted with Assistant Director Tara Erica Robledo. This report was reviewed and a copy provided. Appeal rights were discussed and issued at the time of the exit interview. A Notice of Site Visit was also issued and must remain posted for 30 consecutive days in a location visible to the public.
