What the inspector wrote

Based on records review and LPAs interview, the preponderance of evidence standard has been met and the allegations that Staff do not provide the day-care children with a comfortable environment during nap time, and Staff do not prevent a day-care child from hitting other day-care children are found to be SUBSTANTIATED. The facility is being cited in accordance with Title 22 Child Care Center Regulations, Division 12, Chapter 1, Section 101230(b): Activities and 101223(a)(3): Personal Rights. This poses a potential risk to the health, safety, or personal rights to the children in care. See LIC9099D for cited deficiencies. Exit interview conducted. A copy of this report and appeal rights were discussed and provided to the Education Coordinator Kim Byers on this date. A NOTICE OF SITE VISIT WAS ISSUED AND LPA VERIFIED THAT IT WAS POSTED IN A PROMINENT LOCATION AT THE FACILITY BEFORE LEAVING. THE LICENSEE UNDERSTANDS THAT IT MUST REMAIN POSTED FOR THE NEXT 30 DAYS.

    Activities (b) All children shall be given an opportunity to nap or rest without distraction or disturbance from other activities at the center.The requirement is not met as evidenced by: Child #1 (C1) does not like to take naps and displays disruptive behaviors during nap time. These behaviors interfere with the other children's abilities to take a nap or rest, which poses a potential health, safety or personal rights risk to children in care.
