What the inspector wrote

On 10/30/2024 at 12:14pm, Licensing Program Analysts (LPAs) Jeanette Sanchez and Naomi Hurtado conducted a case management visit to address an issue which arose during a complaint investigation (Control number 10-CC-20240610122503) conducted. On 9/4/2024 at 7:10am, LPA Sanchez arrived at the facility and knocked on the door. LPA noticed movement in the facility, however view was obstructed by documents on window panes of the french doors. LPA crouched to the bottom four panes of the right side door which did not have documents posted. LPA viewed two children unattended - an infant in a car seat and an ambulatory child (record review revealed children to be 11 months old and 2 years old). Both children appeared to be watching a tv which is mounted on the same wall as the french doors. LPA knocked again. At 7:13am, LPA took photographic evidence of unsupervised children. At 7:16am, LPA took video evidence of unsupervised children. At 7:19am, LPA knocked for a third time. Staff greeted LPA. LPA asked staff how long the children had been left unattended, to which staff stated approximately 5 minutes while they retrieved toys from the adjacent playroom. LPA let staff know that she had been knocking for 10 minutes. Staff went to the playroom where the door leading into the main area of the home was open. Staff called for licensee, who was in the main house. LPA spoke with licensee regarding the children being left unsupervised and the infant being left restrained in a car seat. See LIC809D for deficiencies. An exit interview was conducted, and this report was reviewed with the licensee Silveria Aguilar. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

    (a) Each child ...shall have certain rights...not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative...(2) To receive safe, healthful, and comfortable accommodations...This requirement was not met as evidenced by: LPA Sanchez observed an infant left unsupervised and restrained in a car seat for a period of 10 minutes, which poses a potential health, safety or personal rights risk to persons in care.
