What the inspector wrote

On date and time listed, Licensing Program Analyst (LPA) Perla Ordones arrived at the facility to conduct a required/annual inspection as part of a compliance review. LPA toured the facility, inside and out, records were reviewed, and the following was observed and/or discussed: Normal days and hours of operation are: Monday \342\200\223 Friday; 06:30AM \342\200\223 06:00PM. OFF-LIMIT AREAS INCLUDE: Entire second floor, garage, and right hand side yard. The facility is operating within the licensed capacity and appropriate ratios. \302\267 Appropriate supervision provided during this inspection. \302\267 A working telephone is present and current number on file. \302\267 Appropriate fire extinguisher, smoke detector and carbon monoxide detector present and were tested by the Licensee during this inspection. \302\267 Fireplace is properly screened to prevent access by children. \302\267 All hazardous items are stored inaccessible to children. \302\267 Toxins are locked. During the facility tour, LPA observed several poisons/toxin cleaning solutions present underneath the sink. Cabinet was made inaccessible with a tot lock at the time. Licensee moved poisons/toxin cleaning solutions during the visit to a key locked area. \302\267 Weapons are not present. Licensee understands all guns, weapons and ammunition must be key locked separately and made inaccessible per Title 22 Regulations \302\267 Stairs are not barricaded. During facility tour, LPA noted that the staircase leading upstairs did not have a baby gate blocking the direct staircase. Licensee explained they had bought a new baby gate for the stairs and would be installing it soon. \302\267 Verification of control of property on file. \302\267 Facility Sketch, Emergency Disaster Plan & Notification of Parent\342\200\231s Rights poster are posted. \302\267 Mandated Reporter Training not completed. Licensee, S1, and S2 were missing proof of the Child Care Providers Mandated Reporter Training (AB1207). \302\267 Pediatric CPR and First Aid Card expires on 03/2024. \302\267 Health & Safety Certificate - completed on 10/14/2005. \302\267 No bodies of water at this time. Licensee understands all bodies of water including ponds, above ground pools & spas, in-ground pools & spas, and some fountains must be properly covered or fenced per Title 22 Regulations. The Department must be notified before and after installation of the above types of bodies of water. In addition, all wading pools or similar product must be emptied immediately after use and stored in an upright position. \302\267 Clean, safe and age appropriate toys inside. However, during facility tour, LPA observed that a play structure in the backyard with a slide had a section of the structure that had splintered wood. Licensee stated the children had not been outside recently and that the play structure would be fixed or thrown out. \302\267 Current roster on file \302\267 Documentation of fire and disaster drills on file \342\200\223 Last drill conducted on 01/14/2024. \302\267 Children\342\200\231s records are not complete. During record review, LPA observed that 4 children were missing proof of the current 15 minute sleep checks, 9 children were missing proof of the LIC282, 3 children were missing proof of the LIC995A, 3 children were missing proof of the LIC9150, 3 children were missing proof of the LIC627, and 1 child was missing proof of the LIC9227. Additionally, LPA observed that the roster was not complete upon initial inspection. Licensee completed roster during visit. \302\267 Upon arrival, LPA observed that 4 children were sitting in strollers while watching TV. LPA explained to Licensee that children were considered restrained while in the strollers watching TV which is a violation of regulations. Children were taken out of strollers during visit. \302\267 Employee\342\200\231s records are not complete. During record review, LPA observed that S1 and S2 were missing proof of the AB1207 and MMR, Pertussis, Influenza, and Tuberculosis vaccines. \302\267 The Licensee was informed of their reporting requirements and is provided with the Regional Office\342\200\231s Unusual Incident Reporting email mailbox: UnusualIncidentReportsDO09@dss.ca.gov \302\267 Resident and/or staff records reviewed on 01/24/2024 indicate that all adults who require caregiver background checks have received all required clearances or exemptions. \302\267 The Licensee can submit transfer forms to associate new individuals or to disassociate someone from your facility at: Associations_Disassociations862@dss.ca.gov Upon arrival, LPA observed C1 sleeping in a car seat. LPA confirmed with Licensee's assistant, S1, that C1 was asleep. LPA asked that the child be removed from the car seat and placed in designated sleeping area. Additionally, during facility tour, LPA observed that several cribs/play yards had pillows and other loose articles in them. LPA did not observe any children sleeping in the cribs/play yards at the time. LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice)/ (800) 514-0383 (TTY) and link to publication: Commonly Asked Questions about Child Care Centers and the ADA, available at: https://www.ada.gov/resources/child-care-centers/ Licensee was reminded that all adults 18 and over living in the home, persons who provide care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. LPA Perla Ordones informed licensee Sonia Carias that this report dated 01/24/2024 document(s) two Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPA Perla Ordones informed the licensee Sonia Carias to provide a copy of this licensing report dated 01/24/2024 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. During the exit interview, the LICENSEE Sonia Carias confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. Exit interview conducted and report was reviewed with the licensee Sonia Carias.
