What the inspector wrote

On the date and time listed, Licensing Program Analyst (LPA) Samuel Lopez arrived at the facility to conduct an inspection regarding a separate matter/investigation. In the process of the investigation, information was provided to LPA Lopez that a child and/or children had been transported to elementary school, on at least two occasions and each time by a different adult. Additionally, information was obtained that the adults were neighbors to the licensee and did not have a criminal record clearance, which is required to work at a licensed facility. Also, the LPA obtained information that a child had suffered a head injury at the facility. The child had fallen from a couch and hit their head on the hard floor; this resulted in visible bruising on the side of the child’s head. that warranted an incident report to the Department, that the licensee never made. See LIC809-D for cited deficiencies. LPA Samuel Lopez informed Licensee Rosario Fonseca that this report dated 2/24/2026 document(s) (1) Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPA Samuel Lopez informed the Licensee Rosario Fonseca to provide a copy of this licensing report dated 2/24/2026 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. A Civil Penalty ($200.00) has been assessed during this inspection. Payment is due when billed and the check(s) or money orders shall be made payable to the “California Department of Social Services”. YOU WILL RECEIVE AN INVOICE IN THE MAIL. DO NOT SEND MONEY UNTIL YOU RECEIVE YOUR INVOICE. DO NOT SEND CASH. A notice of site visit was given to Licensee Rosario Fonseca and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and report was reviewed with the Licensee Rosario Fonseca. Please note that the licensee was provided with a Technical Support Program (TSP) brochure and the purpose was the program was discussed.

    Criminal Record Clearance: All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing, or volunteering in a licensed facility: Obtain a California clearance or a criminal record exemption as required by the Department. This requirement is not met as evidenced by information disclosed by the licensee and other pertinent sources that on, at least, two occasions their neighbor(s), which did not have a criminal record clearance, transported one or more children to school.     A report shall be made to the department...during the department's normal business hours before the close of the next working day following the occurrence during the operation of a family day care home of any of the following events: Any unusual incident or child absence that threatens the physical or emotional health or safety of any child. This requirement is not met as evidenced information obtained during interviews, that a child suffered a head injury which left a bruise on the side of their head. This poses a potential health, safety or personal rights risk to persons in care.
